AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES , i
IOWA, BY REPEALING SECTIONS 5-2001 AND 5-2003 THEREOF AND ENACTING
NEW SECTIONS 5-2001 AND 5- 2003 FOR THE PURPOSE OF CHANGING PRO- 1
VISIONS WITH RESPECT TO DOGS AND CATS AT LARGE ; PROVIDING A
PENALTY; REPEALING ALL ORDINK\TCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT AND ESTABLISHING !
AN EFFECTIVE DATE.
BE IT ORDAINED BY T:�E CITY COUNCIL FOR THE CITY OF
AMES, IOWA:
Section 1. That the Municipal Code of -the City of
Ames, Iowa, be and the same is hereby amended by repealing Sec-
tions 5-2001 and 5-2003 as said sections have heretofore existed.
Section 2 . That the Municipal Code of the City of Ames
Iowa, be and the same is hereby further amended by enacting new
Sections 5-2001 and 5-2003 to read as follows :
Sec . 5-2001 . Definitions .
The following definitions shall apply in
the interpretation and enforcement of this
article .
(1) At large is J_ntended to mean and include
any dog or cat off the premises of its
keeper and on other premises against the
wishes o-f the person in possession of
such other premises or upon the public
streets, alJ..eys, public grounds, school
grounds or parks within the city. A
dog or cat shall not be deemed at large
if .
(a) It is attached to a :_eash of
sufficient strength to restrain
the animal. and the leash is held
by a person capable of control'_ing
the animal.
(b) It is confined in a vehicle , cage,
or small animal carrier .
(c) It is attended, under voice command,
and in a city park at such place and
time and in compliance with such con-
ditions and provisions, as shall be
established by duly promulgated rules
of the Parks and Recreation Commission.
(2) Cat includes all members of the Felis
domestica species, male or female,
whether altered or not .
(3) Dog includes all domesticated members
of the Canis familaris species, male or
female , whether altered or not.
(4) Keeper includes any person owning,
harboring, sheltering or keeping a
dog or cat.

Sec . 5-2003 . Dogs or cats trespassing,
disturbing the peace .
It is unlawful for any person, firm or
corporation keeping, owning, or sheltering
a dog or cat to allow or permit such
animal to go upon the premises of another
against the wishes of such other person or
to cause damage to or interfere with such
premises, or to cause serious annoyance to
a person or persons by frequent and habitual
howling, yelping, cr barking; provided, how-
ever, that the provisions of this section
relating to said annoyance do not apply to
a duly zoned small animal clinic, operated
by a licensed veterinarian.
Section 3 . Violation of the provisions of this
ordinance shall constitute a misdemeanor.
Section 4 . All ordinances or parts of ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
Section 5 . This ordinance shall be in full force and
effect from and after its pas-sage and publication as required
by law.
