AN ORDINANCE TO AMEND THE MU14ICIPAL CODE OF THE CITY OF AMES, IOWA,
BY REPEALING SECTIONS 17-2002 THROUGH 17-4011 INCLUSIVE AND
ADOPTING NEW SECTION 17-2002 .AND 17-2003 FOR THE PURPOSE OF
REVISING THE HEALTH AND SANITATION ORDINANCES OF THE CITY OF AMES
SO AS TO MAKE SUCH ORDINANCES CONSISTENT WITH THE PRESENT LAWS OF
THE STATE OF IOWA AND TO REPEAL OBSOLETE AND UNNECESSARY
PROVISIONS ; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; PROVIDING A PENALTY; AND ESTABLISHING AN
EFFECTIVE DATE.
BE IT ENACTED BY THE CITY COUNCIL FOR THE CITY OF AMES ,
IOWA:
Section 1. That the Municipal Code of the City of Ames,
Iowa, be and the same is hereby amended by repealing Sections
17-2002 through 17-4011 inclusive as said sections have heretofore
existed.
Section 2 . That the Municipal Code of the City of Ames,
Iowa, be further amended by enacting new sections 17-2002 and
17-2003, said new sections to read as follows :
"Sec. 17-2002 . Powers of board_.
The Board of Health shall have the following
powers :
1. To enforce the state health laws and
the rules and lawful orders of the
State Department of Health.
2 . To make and enforce such reasonable
rules and regulations not inconsistent
with law or with rules of the State
Board of Health as may be necessary
for the protection and improvement
of the public health. Such rules and
regulations shall become effective
upon approval of the city council
and publication in a newspaper having
general circulation in the city.
Before approving any rule or regulation,
the Board of Health shall hold a public
hearing on the purposed rule or regulation.
The notice of the public hearing, stating
the time and place and the general nature
of the proposed rule or regulation shall
be published at least ten (10) days before
the hearing in a newspaper of general
circulation in the area served by the
Board.
Sec. 17-2003 . Penalties .
Any person who violates any rule or
regulation of the Board or refuses to
obey any lawful order of said Board, its
officers or authorized agents shall be
guilty of a misdemeanor. Each additional
day of neglect or failure to comply with
such provision, rule or lawful order after
notice of violation by the local Board
shall constitute a separate offense. "

Section 3. All ordinances and parts of ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
Section 4 . Violation of the provisions of this ordinance
shall constitute a misdemeanor.
Section 5. This ordinance shall be in full force and
effect from and after its passage and publication as required by
1 aw.
