ORDINANCE NO. 2508
AN ORDINANCE A'IENDING THE MUNICIPAL CODE OF THE CITY OF AMES ,
IOWA, BY REPEALING CHAPTER T17O THEREOF AS SAID CHAPTER HAS
EXISTED HERETOFORE AND ADOPTING A NET4 CHAPTER TWO FOR THE
PURPOSE OF REVISING PROVISIONS AND PROCEDURES RELATIVE TO THE
CITY ADMINISTRATION ; REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT;
AND, ESTABLISHING PST EFFECTIVE DATE .
BE IT ENACTED, by the City Council for the City of Ames ,
Iowa:
Section 1 . The Municipal Code of the City of Ames ,
Iowa, is hereby amended by repealing Chapter Two thereof,
Administration, as said chapter has heretofore existed.
Section 2 . The Municipal Code of the City of Ames ,
Iowa , is hereby further amended by adopting a new Chapter Two,
Administration , to read as follows :
CHAPTER 2
ADMINISTRATION
Article I . In General
Sec . 2-1001. City seal described; declared
official.
The corporate seal of the city has in its
center the words "Ames , Iowa , and around the
margin the words "City Seal, " and such seal is
hereby declared to be the official seal of the
city .
Sec. 2-1002 . Bonds required.
The officers and employees of the city,
herein named, before entering upon the dis-
charge of their respective duties , shall,
in addition to the oath affirmation required
by law , execute a bond to the city with a
fidelity or indemnity company authorized by
law to do business in this state to be
approved. by the city council , conditioned for
the faithful performance of their duties and
that they will account for and pay over to
the person entitled to receive the same all money
or property belonging to said city which may
in any manner come into their hands , in the
following sums , respectively :

At the discretion of the city council , the
aforesaid bond requirements may be met by a
single blanket bond, except that there shall
be separate bonds for the mayor r.nd mayor
pro tem.

Sec. 2-1003 . Where bonds filed.
Each of the bonds required by section 2-1002
above shall be filed in the clerk ' s office.
Sec. 2-1004 . Payment of bond premiums.
The premium costs for all fidelity bonds
required by section 2-1003 , shall be paid by
the city from the general fund.
Article II . Mayor
Sec . 2-2001. Powers generally.
The mayor has all the powers and shall
perform such duties as are conferred or directed
by the statutes of the state or as required
by ordinance or resolution of the city council.
Sec . 2-2002 . To preside over council;
right to vote .
The mayor shall preside at meetings of the
city council . The mayor is not a member of
the council and may not vote as a member of
the council, except that the mayor may vote
to break a tie on motions .
Sec . 2-2003 . Duty to maintain office, keep
seal .
The mayor shall keep an office in the city,
and shall provide for the keeping of the
corporate seal thereof.
Sec. 2-2004 . Duty to sign documents .
The mayor shall sign all commissions , licenses ,
and permits granted by authority of the council,
except otherwise provided by ordinance, and
sign or certify such other documents as by
law or ordinance require his signature or
certificate .
Sec . 2-2005 . Mayor' s action on council
measures .
The mayor may sign, veto or take no action
on an ordinance, amendment or resolution passed
by the council .
Measures passed by the council, other than
motions , become effective in the following
ways
(a) If the mayor signs the measure, a
resolution becomes effective immediately
upon signing and an ordinance or amend-
ment becomes law when published unless
a subsequent effective date is provided
within this measure.
(b) If the mayor vetoes the measure, he shall
explain his reasons for the veto in a
message to the council at the time of
the veto . Within thirty (30) days
after the mayor 's veto, the council
may pass the measure again by a vote of
not less than two-thirds of the council
members . If the mayor vetoes a measure

and the council repasses the measure
after the mayor 's veto, a resolution
becomes effective immediately upon
repassage, and an ordinance or amendment
becomes a law when published, unless
a subsequent effective date is provided
within the measure.
(c) If the mayor takes no action on the
measure, a resolution becomes effective
fourteen (14) days after the date of
passage and an ordinance or amendment
becomes a law when published, but not
sooner than fourteen (14) days after
the date of passage, unless a subsequent
effective date is provided within the
measure .
Sec. 2-2006 . Power to remove appointees .
The mayor may remove any person appointed
to office by him, subject to the provisions
of Chapter 365, Code of Iowa, 1975, (civil
service) , but every such removal shall be by
written order, and shall give the reasons
therefore , and the order shall be filed with
the city clerk .
Sec. 2-2007 . Authority to sue to void plats .
The mayor may upon resolution of the council,
institute a suit in equity in the district
court to void any plat of the city filed and
recorded in violation of law.
Sec. 2-2008 . Authority to apply for labor
arbitration .
The mayor may make written application to
the governor for appointment of a board of
arbitration and conciliation in labor disputes ,
as provided in Chapter 90 , Code of Iowa, 1975.
Sec. 2-2009 . Duty to sign contracts .
The mayor shall , in behalf of the municipality,
sign all contracts between the municipality and
any other party where the contracts are authorized
and directed to be made by the council ,
except in cases where some other person or
committee is expressly authorized to do so.
Sec . 2-2010 . Reserved.
Sec . 2-2011 . Duty to sian, seal bonds .
The mayor shall sign all bonds issued by the
city and affix the corporate seal thereto.
Sec. 2-2012 . Duties relating to health.
The mayor shall be chairman of the local
board of health and as chairman of said
board shall enforce the statues of the state
relative to public health, the rules of the
state department of health and the local board .

Sec. 2-2013 . Appointment of advisory committees .
The mayor may , from time to time, by and
with the approval of the council , appoint
advisory committees for the purpose of obtaining_
information and making recommendations to the
council .
Sec. 2-2014 . Appointment of police personnel.
The mayor shall appoint a marshall or chief
of police . All other appointments and pro-
motions of police personnel shall be made by the
chief of the police department from among
persons certified eligible for such appoint-
ment or promotion by the Civil Service
Commission.
Sec . 2-2015 . Other powers of mayor and mayor
pro tem.
(1) The mayor is the chief executive officer
of the city and presiding officer of the
council . Except for the supervisory
duties which have been delegated by
ordinance to the city manager, the mayor
shall supervise all city officers and
departments .
(2) The mayor may take command of the police
and govern the city by proclamation when
he determines a time of emergency or
public danger exists . Within the City
of Ames he has all the powers conferred
upon the sheriff to suppress disorders .
(3) The mayor pro tem is vice-president of
the council. When the mayor is absent
or unable to act, the mayor pro tem shall
perform the mayor' s duties , except that
the mayor pro tem may not appoint,
employ or discharge officers or employees
without the approval of the council .
Official actions of the mayor pro tem
when the mayor is absent or unable to
act are legal and binding to the same
extent as if done by the mayor. The
mayor pro tem retains all powers of a
councilmember.
Sec. 2-2016 . Salary.
The mavor shall receive a yearly salary
of three thousand dollars ($3 , 000) per a_nnum.
Article III . City Council
Division I . Generally
Sec. 2-3001 . Membership; powers generally .
The council consists of six (6) members , one
from each of the four ( 4) wards , and two (2)
elected from the city at large . The council
shall have such powers as are now or may
hereafter be conferred by the laves of the
State of Iowa.
Sec. 2-3002 . Appointment of officers .
The city clerk, city manager, and city
attorney shall be appointed by the city
council for such term as the city council

may prescribe at the time of appointment, and
during the term of said appointment shall be
subject to removal only by a. vote of the
majority of the whole number of the city
council.
Sec . 2-3003 . Legislative powers , functions .
The council has and shall exercise all
legislative powers and functions conferred
upon the city by the laws of the state.
Sec . 2-3004 . Regular meetings .
Regular meetings of the city council will
be held on the first, third and fourth Tuesdays
of each month at 7 : 30 p.m, except when the
council shall , by motion at a prior meeting, set
an alternate date or time, or cancel a meeting
or determine to hold additional meetings during
a month .
Sec. 2-3005 . Quorum; compelling attendance.
At all meetings of the council four (4)
;.members shall be necessary to constitute a
quorum, but a smaller number shall have
jurisdiction to adjourn to any date prior to
that of the next regular meeting or the council
by ordinance may compel the attendance of
absent members in such manner and under such
penalties as they may prescribe.
Sec . 2-3006 . Special meetings .
The council shall hold special meetings when
called by the mayor or four (4) members of the
council . Notice thereof shall be given personally
or left at the usual place of residence of
each member of the council by the chief of
police, or his deputy, and a record of the
services of notices shall be returned to the
clerk and a record of such services made by
him.
Sec. 2-3007 . Appointment of temporary chairman.
The council shall in the absence of the mayor,
mayor pro tempore , or clerk appoint a temporary
chairman or clerk, as the case may be, from
their own number , which appointment shall be
entered of record.
Sec . 2-3008. Authority to determine rules of
proceedings .
The council shall determine the rules of its
own proceedings consistent with the laws of
the State of Iowa.
Sec. 2-3009 . Vacancy in elected city office.
A vacancy in an elected city office during
a term of office must be filled by the council
for the period of time until the next regular
city election.
Sec . 2-3010 . Ordinances and amendments.
The subject matter of an ordinance must be
generally described in its title.

An amendment to an ordinance or to the
Municipal Code must specifically repeal the
ordinance or code, or the section or subsection
to be amended, and must set forth in full the
ordinance , code, section or subsection as
amended.
Sec . 2-3011. Procedure for enactment of
ordinance or amendment.
A proposed ordinance or amendment must be
received and placed on file at two council
meetings prior to the meeting at which it is
to be finally acted upon, unless this requirement
is suspended by a recorded vote of not less
than three-fourths of the councilmembers.
However, if a summary of the proposed
ordinance or amendment is published at least
once , in a newspaper having at least weekly
general circulation within the City of Ames, not
less than ten (10) days nor more than twenty-
five (25) days before its first filing with the
city council , and copies are available at the
time of publication at the office of the city
clerk, the ordinance or amendment must be
received and placed on file at only one meeting
prior to the meeting at which it is to be
finally acted upon , unless this requirement
is suspended by recorded vote of not less than
three-fourths of the councilmembers .
Sec . 2-3012 . Vote required.
Passage of an ordinance, amendment or
resolution requires an affirmative vote of not
less than a majority of the councilmembers .
P_ motion to spend public funds in excess of
Ten Thousand Dollars ($10, 000) on any one pro-
ject, or a motion to accept public improve-
ments and facilities upon their completion ,
also requires an affirmative vote of not less
than a majority of the councilmembers . Each
councilmember ' s vote on an ordinance , amendment
or resolution must be recorded.
Sec . 2-3013 . Compensation of councilmembers .
Each councilmember shall receive as full
compensation for his or her services the sum
of Six Hundred Dollars ($600 . 00) per annum,
payable as the council may direct; provided,
that after January 1 , 1978, a councilmember
will be paid One Thousand Eight Hundred Dollars
($1, 800 . 00) per annum.
Sec. 2-3014 . Appointment of committees.
The mayor may appoint, from members of the
council , committees to perform specific
assignments as the need arises .
Sec. 2--3015 - 2-3019 . Reserved.
Division 2 . Rules of Procedure
Sec. 2-3020 . Scope.
The following rules shall govern the meetings
of the council and its order of transaction of
business :

Sec. 2-3021. Preservation of order; deciding
questions; appeals from the chair.
The mayor or in his absence the mayor pro
tempore or chairman shall preserve decorum and
shall decide questions of order subject to an
appeal to the council . A member called to
order shall immediately suspend his remarks
until permitted by the mayor to explain. If
there is no appeal, the decision of the chair
shall be conclusive; but if the member
appeals to the council from the decision of
the chair, the council shall decide the
question without debate.
Sec. 2-3023 . Motions , resolutions to be
seconded; statement; when to be
written.
No motion or resolution shall be put until it
is seconded. When seconded, it shall be stated
by the mayor or presiding officer before debate.
Upon request of the chair or any councilman,
every motion shall be reduced to writing.
Sec. 2-3024 . Withdrawal of motions .
After a motion or resolution is stated by
the chair, it shall be deemed in the possession
of the council, but it may be withdrawn at
any time before decision or amendment.
Sec. 2-3025. Name of movant to be recorded.
In all cases where a resolution or a motion
is entered on the minutes of the city council
the name of the member moving the same also
shall be entered.
Sec. 2-3026 . Preferential motions .
When a question is under debate, the only
motions in order shall be:
FIRST To adjourn.
SECOND The previous question..
THIRD To lay on the table.
FOURTH To postpone indefinitely.
FIFTH Adjourn to a certain day.
SIXTH To refer.
SEVENTH To amend.
Such motions shall have precedence in the
order herein arranged, the first three (3)
to be decided without debate.
Sec. 2-3027 . When motion to adjourn is in
order.
A motion to adjourn the city council shall
always be in order, except:
(a) When a member is in possession of the
floor .
(b) When the members are voting.
(c) When adjournment was the last preceding
motion.

(d) When it has been decided that the pre-
vious question shall be taken.
Sec. 2-3028. Amendment, debate of motions
to adjourn.
A motion simply to adjourn cannot be amended;
but a motion to adjourn to a given time may be,
and is open to debate .
Sec. 2-3029 . Putting the previous question.
When the previous question is moved and put
it shall be in this form "Shall the main question
be now put?" If this is carried, all proposed
amendments and all further motions and debates
shall be excluded, and the question is put
without delay.
Sec . 2-3030 . Amendment, debate of motions to
table .
A motion to lay a question on the table
simply is not debatable but a motion to lay on
the table and publish, or any other condition,
is subject to amendment and debate.
Sec. 2-3031 . Indefinite postponement of motions .
When a motion is postponed indefinitely it
shall not be taken up again during the same
meeting.
Sec . 2-3032 . Precedence of motions to refer
to committee.
A motion to refer to a standing committee
shall take precedence over a similar motion
for a special committee.
Sec. 2-3033. Motions to amend.
(a) A motion to amend an amendment shall
be in order; but a motion to amend an amendment
to an amendment shall not be entertained.
(b) An amendment modifying the intention of
a motion shall be in order but an amendment
relating to a different subject shall not be
in order.
Sec. 2-3034 . Motions to strike and insert.
On motion to "strike out and insert" the
paragraph to be amended shall first be read
as it. stands , the words proposed to be
struck out, and those to be inserted, and finally
the paragraph as it would stand if so amended.
Sec. 2-3035. Timliness of motions to
reconsider .
A motion may be reconsidered at any time
during the same meeting , or at the first
meeting held thereafter. A motion for a
reconsideration being once made, and decided
in the negative, shall not be renewed before
the next meeting.

Sec. 2-3036 . Who may move to reconsider.
A motion to reconsider must be made by
members who voted in the majority, or by
those who were absent and did not vote
upon the question to be reconsidered.
Sec. 2-3037. Reconsidering motions more
than once .
No question shall be reconsidered more than
once , nor shall a vote to reconsidez be
reconsidered.
Sec. 2-3038 . Suspension of rules.
The foregoing rules may be suspended for a
certain meeting or a certain purpose only
by the unanimous vote of the council.
Sec. 2-3039 . Applicability of Robert' s
Rules of Order.
Upon questions arising not covered by this
division, Robert' s Rules of Order shall
govern.
Article IV. City Clerk
Sec. 2-4001. Reserved.
Sec. 2-4002 . Oath, bond.
Within ten (10) days after appointment,
the city clerk shall qualify by taking an
oath. Such oath shall be filed in the office
of the city clerk.
Sec. 2-4003 . Powers , duties generally.
The city clerk shall exercise all the
powers and perform all the duties provided
or prescribed by state law, the provisions
of this Code or other ordinances o-` the
city.

Sec. 2-4004 . Duty to publish statement of
proceedings and accounts .
The city clerk shall, immediately following
a regular or special meeting of the council,
prepare a condensed statement of the proceedings
of the council, including the total expenditure
from each municipal fund, and cause the same to
be published in a newspaper of general
circulation in the city, said statement to
include a list of all claims allowed and a
summary of all receipts .
Sec. 2-4005 . Record of council meetings .
The city clerk or deputy shall attend all
meetings of the city council and shall !
1 . Promptly record each measure, with a
statement, where applicable, indicating
whether the mayor signed, vetoed, or took
no actin on the measure, and whether
the measure was repassed over the mayor ' s
veto .
2 . Publish all ordinances and amendments
in the manner required by law.
3 . Authenticate all measures except motions
with a signature and certification as
to time and manner of publication, if any.
4 . Maintain for public use copies of all
effective ordinances and codes .
5. Immediately after the effective date of
a measure establishing any zoning
district, building lines or fire limits ,
the city clerk shall certify the measure
and a plat showing the district, lines , or
limits to the county recorder to be
recorded in the miscellaneous book or
other book provided for special records .
Sec. 2-4006 . Custody of bonds , contracts .
The city clerk shall have custody of all
bonds and contracts belonging to the city
except where otherwise provided by state
law, the provisions of this code or other
ordinances of the city.
Sec. 2-4007 . Recording, certification of
special assessments .
The city clerk shall keep a record of all
special assessments levied by the city and
shall certify such assessments and other
assessments made by the council to the
county auditor .
Sec. 2-4008 . Record of licenses required.
The city clerk shall keep an accurate
record of all licenses issued by the clerk,
which record shall show the name of the in-
dividual, partnership or corporation to whom
such license was issued and the fee collected
therefore in each instance .

Sec . 2-4009. Record of official bonds required.
The city clerk shall keep a record to be
known as the "Record of Official Bonds" and
shall record therein the official bond of all
municipal officers, elective or appointive,
and shall index such record under the title
of each office and shall show the name of each
principal, sureties , and the date of
the filing of the bond.
Sec . 2-4010 . Duty to keep cemetery records .
The city clerk shall keep all permanent
cemetery records of the Ames Municipal Cemetery,
as provided by this Code and other ordinances
relating thereto .
Sec. 2-4011 . Duty to account for, pay over
monies .
All funds of the city coming into the hands
of the city clerk shall be promptly accounted
for and turned over to the director of finance
for disposition as provided by law.
Sec. 2-4012 . To be clerk of civil service
commission.
The city clerk shall be the clerk of the civil
service commission, keep such records and per-
form such other duties as required by the laws
of Iowa, the ordinances of the city or as
prescribed by such commission.
Sec. 2-4013 . To be clerk of board of health.
The city clerk shall be the clerk of the
local board of health, keep its records, and
perform such other duties as provided by the
laws of Iowa, and the ordinances of the city
or as provided by said board.
Sec. 2-4014 . To be secretary of zoning board
of adjustment.
The city clerk shall act as secretary of the
zoning board of adjustment and keep the records
thereof_ .
Sec. 2-4015 . Control over cigarette permits .
The city clerk shall have charge and control
of the issuance of cigarette permits authorized
by law to be issued by cities .
Sec. 2-4016 . Authority over subordinates .
The city clerk has authority to appoint
deputies .
Sec . 2-4017 . Disposition of old records .
The city clerk shall, on order of the council,
destroy all records and papers other than pro-
ceedings, ordinances, instruments dealing with
real estate and bond issues, which are more
than ten (10) years old, or offer such of them
as may be of historical interest to a historical
society or a public library.

Article V. City Manager
Sec. 2-5001 . Office created.
By virtue of authority conferred by law,
the office of city manager is hereby created
and continued in the city.
Sec . 2-5002 . Appointment, tenure , removal.
The city manager shall be appointed by a
majority vote of the city council at a
regular meeting, and the manager shall hold
office during the pleasure of the city council
and be subject to removal only by a majority
vote thereof.
Sec. 2-5003 . Manager supersedes other officers
when powers overlap.
Whenever, by ordinance of the council the
powers and duties heretofore vested in any
other appointive municipal offices are to be
wholly performed by the city manager, then no
such appointment of such appointive offices
shall be made , and any appointment of such
offices made prior to the adoption of
such ordinance shall be thereby cancelled.
Sec . 2-5004 . Administrative assistants .
The city manager is empowered to appoint, with
the approval of the council , such administrative
assistants as he shall deem advisable. Such
administrative assistants , in the city
manager ' s absence , may do and perform all the
acts and duties that may be authorized and
required to be performed by the city manager,
subject at all times to the orders of the
city manager.
Sec . 2-5005 . Duties and powers of the city
manager.
The city manager shall be the chief administ-
rative officer of the city and head of the
administrative service . As such, he shall :
1. Supervise enforcement and execution of
the city laws .
2 . Attend all meetings of the city council.
3 . Recommend to the council any measures
necessary or expedient for the good
government and welfare of the city.
4 . Supervise the official conduct of all
officers and employees of the city whom
he has appointed and take active control
of the police department.
5. Supervise the performance of all contracts
for work to be done for the city , make all
purchases of materials and supplies and
see that such materials and supplies are
of the quality called for, except with
respect to the municipal hospital, and
the Ames Public Library.

I6 . Supervise the construction, improvement,
repair, maintenance and management of all
city property, capital improvements and
undertakings of the city, including the
making and perservation of all surveys ,
maps , plans, drawings , specifications,
and estimates for capital improvements ,
except with respect to the municipal
hospital and the Ames Public Library.
7 . Cooperate with, and give assistance
requested by, the Ames Municipal Hospital
Board of Trustees, the Board of Trustees
of the Ames Public Library, or any other
administrative agency, board, commission
or committee of the city .
8 . Be responsible for the cleaning, repair,
maintenance and lighting of streets ,
alleys , and public places; and, the
collection and disposal of garbage and
solid waste .
9 . Provide for and cause records to be
kept of the issuance and revocation of
licenses and permits authorized by city
law for issuance by the city manager
or his appointees .
10 . Keep the council fully advised of the
financial and other conditions of the
city, and of its future needs.
11. Prepare and submit to the council, for
approval, the necessary budgets .
12 . Conduct the business affairs of the city
and cause accurate records to be kept
by modern and sufficient accounting
methods .
13 . Make , to the council , not later than
the loth dFy of each month, an itemized
financial report in writing, showing the
receipts and disbursements for the
preceding month, and insure that copies
of such financial reports are available
at the office of the city clerk for
public distribution.
14 . Appoint a treasurer subject to the approval
of the council .
15 . Perform such other duties as are within
the discretion of the council to direct.
16 . Employ, reclassify, promote, demote, or
discharge employees and fix their compen-
sation, subject to the provision of the
Iowa Civil Service Law and the Soldiers
Preference Law when applicable, except
where employment authority is vested in
the Ames Municipal Hospital Board of
Trustees , the Board of Trustees of the
Ames Public Library, the city clerk,
or the city attorney .
17 . Appoint himself or some other officer or
employee to assume, in an acting capacity,
the performance of the duties of any

office or position in the administrative
service which i-I vacant or lacks administ-
rative service which is vacant or lacks
administration due to the absence or
disability of the incumbent.
18. Have the power to set aside any action
taken by a department head or employee
within the administrative service, to
supersede such department head or
employee in the performance of work and
duties of the position; and, to direct
any department or division of the
administrative service to perform work
for any other department or division
thereof.
19 . Have the power to prescribe and promulgate
rules , regulations and. procedures as
deemed necessary or expedient for the
conduct of the officers and work of the
administrative service.
20 . Have the power to designate from the
administrative service such committees
and officers thereof as he shall find
necessary for the proper consideration
of administrative problems . Such
committees shall meet at the request of
the city manager and shall make such
recommendations on matters referred to
them or they shall find necessary for
the best interests of the city.
21 . Be Civil Defense Director for the City
of Ames, and perform such other duties
as the council shall direct.
Sec. 2-5006 . Departmental organization.
The administrative service of the city shall
be divided under the city manager into the
following departments and heads thereof:

appointed by the mayor, and be immediately
responsible to the city manager for the
effective administration of their
respective departments and all activities
assigned thereto .

2. Keep informed as to the latest practices
in their particular field and shall
inaugurate, with the approval of the
city manager, such new practices as
appear to be of potential benefit to the
administrative service and to the public.
3 . Have power, when it is delegated by the
city manager, to appoint and remove,
subject to the Civil Service Law when
applicable, all subordinate personnel .
Sec. 2-5007 . Personnel department.
The personnel department shall provide
technical support and expertise to the city
manager, the hospital administration and the
library administration on request, with regard
to all matters of personnel administration and
shall have responsibility for such personnel
related matters within the administrative
service as the city manager shall direct.
The personnel department will design and
recommend for adoption by the Civil Service
Commission valid tests for determining
eligibility for appointment and promotion to
positions of city employment and further assist
the Civil Service Commission in the discharge
of its responsibilities in whatever manner the
Commission shall request consistent with the
laws of the State of Iowa and the United
States .
Sec. 2-5008 . Department of finance.
In all cases where the duty is not expressly
charged to any other department or office,
it shall be the function of the finance depart-
ment to act to promote, secure and preserve
the financial and property interest of the
city. The department of finance shall encompass:
1 . The city treasurer , who shall perform all
duties required by law of the city
treasurer, plus such additional duties
as shall be determined by the director
of finance or the city manager.
2 . The data processing service.
3 . Billing and accounting for all fees and
charges for city utilities and other
fees and charges owed to the City of
Ames .
4 . Accounting for all monies received and
disbursed by the City of Ames , its
agencies and enterprises .
5 . Such other work as shall be assigned by
the city manager.
Sec. 2-5009 . Police department.
The police department shall attend to the
enforcement and maintenance of law, the
protection of persons and property and the
preservation of peace within the city. The

police department shall conduct investigations
to detect the commission of crime, investigate
all complaints of violations of the laws of
the State of Iowa or the City of Ames , prepare
evidence for the prosecution of criminal cases ,
and perform all other duties incumbent upon
law enforcement officers under the laws of the
State of Iowa.
Sec . 2-5010 . Fire department.
The fire department shall attend to the
prevention of fires and the protection of
life and property against fire and in this
regard shall:
1. Maintain fire fighting personnel and
equipment in a state of readiness to
put out fires and save life and
property from fire.
2 . Investigate and determine the cause of
fires that occur.
3 . Enforce the fire prevention laws of the
City of Ames and the State of Iowa .
4 . Conduct educational fire prevention
programs .
5 . Perform other public services of an
emergency nature .
Sec. 2-5011 . Public works department.
The department of public works shall attend
to all matters relating to the construction,
management, maintenance and operation of the
physical properties of the city . It shall
include:
1. A division of engineering, supervised
by a civil engineer, which shall perform
all engineering services for the
department of public works and such
other department, agencies and enter-
prises of the city as may from time to
time require such services .
2 . A division of water distribution and
sanitary and storm sewer maintenance
which shall attend to the construction,
operation and maintenance of the city
water distribution and sewage systems .
3 . A division of cemeteries which shall
operate and maintain all city cemeteries .
4 . A division of streets which shall maintain
and repair all streets and alleys and
related traffic control signs and
signals .
5 . A division of solid waste management and
disposal which shall be responsible for
the operation of all plants and facilities
maintained by the city for disposal of
garbage and solid waste.

ec. 2 5012 . Department of community development.
The department of community development shall
attend to protecting and preserving a quality
living environment within the city; planning,
for the future growth and development of the
city; insuring safe and sanitary housing for
all residents of the city; and planning
and implementing programs of federal assistance
related to housing and community development.
The department shall include :
1. A division of planning which shall
provide professional expertise in the
field of urban planning with regard
to:
(a) Land use planning and regulation.
(b) Subdivision planning and regulation.
(c) Design and location of future public
improvements and facilities .
(d) Projecting and planning for the
future growth of the city .
2 . A division of housing, which will be
responsible for planning and imple-
menting projects and programs of public
housing and housing assistance and
all attendant procedures and processes .
3. A division of permits and inspections
which shall be headed by the city building
official and which shall be responsible
for:
(a) Issuance of all permits and inspection
of all work done under the electrical,
plumbing, housing and building codes
of the city.
(b) Adrinistration and enforcement of
city zoning ordinances .
(c) Administration and enforcement of
subdivision laws, regulations and
procedures .
Sec. 2-5013 . Water and water pollution control.
The department of water and water pollution
control shall attend to insuring an adequate
supply of potable water, water treatment,
filtration and purification; and, protection
of water supplies and natural waterways from
pollution by noxious effluent and chemicals.
Sec . 2-5014 . Electric.
The electric department shall attend to the
generation and distribution of electrical
energy.
Sec. 2-5015 . Health and sanitation.
The department of health and sanitation shall
enforce the health and sanitation laws and
ordinances , provide technical staff assistance
to the board of health, operate an animal
shelter and enforce laws and ordinances relating
to the control and protection of animals in
the city .

Sec. 2-5016 . Department of transportation.
The department of transportation shall attend
to the licensing and regulation of taxicabs and
common carriers in the city; manage and operate
any municipally owned urban transit systems in
the city, and manage and supervise the Ames
Municipal Airport.
Sec. 2-5017 . Central services .
The department of central services shall
include :
1. A division of purchasing which shall
supervise or conduct the purchasing
of all supplies and equipment for all
departments of the administrative service
and central stores of supplies and
materials for the administrative service
in accordance with contracting and
purchasing rules , regulations and pro-
cedures adopted by resolution of the
city council.
2 . The city shops and motor vehicle main-
tenance garage which will attend to the
care and preservation of the motor
vehicles , equipment, tools, appliances
and personal property of the city used in
the administrative service.
3 . A division of printing %
Sec. 2-5018. Parks and recreation.
The parks and recreation department shall
attend to the planning, development and
preservation of a system of public parks within
the city. It shall be responsible for the
supervision, maintenance, and administration
of all municipally owned swimming pools and
recreation facilities ; and, shall plan,
supervise, administer and evaluate all
cultural and recreational programs and act-
ivities undertaken or assisted by the city.
Article VI . City Attorney
Sec. 2-6001. Reserved.
Sec. 2-6002 . Powers and duties.
The city attorney shall be head of the legal
department of the city and supervise such assis-
tants as may be appointed. The city attorney
and his assistants when so directed by the
city attorney, shall have the following
powers and duties :
(a) Opinions . The city attorney shall give
his legal opinion upon all questions of
law arising out of any ordinances, suits ,
claims , or demands for or against the city,
and shall give such opinion in writing
unless otherwise so requested, which said
opinion shall be filed and preserved
among the records of the city clerk.

(b) Legal advisor. He shall act as legal
advisor to all city officials , boards and
commissions as far as their or its official
duties are concerned, when requested to
do so by said officials, boards and com-
missions .
(c) Ordinances. He shall report to the city
council any defects that he may discover
in any ordinance, and shall draw such
ordinances as may be requested by the
city council.
(d) Contracts and litigation. He shall, when
directed to do so by any city official,
board or commission, draw all contracts
between the city and other parties ,
prosecute and defend all suits or other
matters in which the city shall be a
party , take appeals in such cases as the
interest of the city requires, and prosecute
or defend the city's interest in all the
courts of the state and of the United
States, all subject, however, to the direc-
tion of the city council; provided, however,
that he is authorized and directed to
prepare, sign and file proper informations
when there is in his opinion sufficient
evidence to warrant the belief that a
person is guilty and can be convicted of
a violation of the city ordinance, and to
prosecute any and all such informations to
judgment and on appeal when authorized by
the city council.
(e) Membership on boards. He shall be a member
of the board of trustees of the retirement
funds for policemen and firemen and an
ex officio member, without vote, on the
board of trustees of the retirement
system for utility employees and such other
boards as are designated by the city
council.
(f) Sign legal papers. He is authorized to
sign the name of the city to bonds and
papers of whatever kind necessary in legal
proceedings forthe prosecution of any
suit in court when directed to do so by
the city council.
(g) Deliver effects of office to successor .
He shall transmit to his successor a
docket of all cases pending wherein the
city is a part, as well as all books ,
papers and documents in his possession
belonging to the city.
Sec. 2-6003. Duties of assistant.
The assistant city attorney shall attend the
traffic court sessions of the municipal court,
prosecute all traffic and other ordinance
violations ; confer with the police department
and other departmens concerning ordinance
violations ; perform the duties of the city
attorney in his absence; and perform such other
duties as may be directed by the city attorney.

Sec. 2-6004. Reimbursement for official
expenses.
The city attorney and his assistants shall be
reimbursed for all money necessarily expended
and actually paid out in attending to official
business , which expenses , after a full report
as to the amount claimed and for what purpose,
shall be passed upon by the city council and
paid as other claims .
Sec . 2-6005 . Reserved.
Section 3 . Any and all ordinances in conflict herewith
are hereby repealed to the extent of such conflict.
Section 4 . This ordinance shall be in full force and
effect from and after July 1, 1975 .
