AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES,
IOWA, BY ADDING TO CHAPTER FIFTEEN, FIRE PROTECTION AND PREVENTION
A NEW ARTICLE III, SERVICE STATIONS AND BULK PLANTS FOR THE
PURPOSE OF ESTABLISHING REGULATIONS FOR THE CONSTRUCTION ,
OPERATION AND MAINTENANCE OF GASOLINE SERVICE STATIONS AND BULK
STORAGE PLANT WHEREIN GASOLINE, MOTOR FUEL OR FUEL OIL ARE
STORED AND DISPENSED; AND, ESTABLISHING AN EFFECTIVE DATE .
BE IT ORDAINED, by the City Council for the City of
Ames , Iowa, that:
Section 1 . The Municipal Code of the City of Ames be,
and the same is hereby, amended by adding to Chapter 15 thereof
a new Article to read as follows ;
ARTICLE III . SERVICE STATIONS AND BULK PLANTS
Division 1. Permits
Sec. 15-3001 . Required.
No person shall, within the corporate limits
of the city, erect, construct, operate or
maintain what is commonly known as a gasoline
service station or bulk storage plant wherein
gasoline, motor fuel or fuel oil are dispensed
unless they shall have first obtained a permit
therefore approved by the city council.
Sec. 15-3002 . Reserved..
Section 15-3003 . Application required; contents .
Each application for a gasoline service station
or bulk storage plant permit shall be filed
with the city manager on forms furnished by the
city, and shall contain the following informa-
tion-
(a) Name and address of applicant.
(b) Proposed. location of the service
station or bulk storage plant is to be
located.
(c) Name and address of owner of the pro-
perty on which the proposed service
station or bulk storage plant is to be
located.
(d) Name and address of the operator of
the service station or bulk storage
plant.
(e) The maximum amount of each kind of
flammable liquid storage to be
provided in the proposed location.
(f) A detailed plat of the service station
or bulk storage plant, properly drawn
to scale, which plat shall show the
location of all buildings , storage
tanks , driveway entrances , fuel pumps
and accessories situated or to be
situated thereon, all finished surface
grades and all proposed electric , water,
gas and other utility service con-
nections .

(g) That an application for a building
permit for the proposed construction
has been approved by the building
official and the number of such building
permit.
(h) If signs are to be erected which
extend bevond the property line, the
permit number for such signs.
Sec. 15-3004 . Investigation of location.
Upon the filing of an application for a
permit hereunder, the city manager shall cause
an investigation to be made of the proposed
location with reference to any hazardous fire
or safety conditions , or traffic congestion
that might be created by the proposed construc-
tion, and report the conclusion of such
investigation to the city council.
Sec. 15-3005 . Issuance .
After receiving the report of the city
manager, the city council may instruct the
city clerk to issue the permit when advised
by the city manager that all conditions as
set forth in the application and this division
have been complied with.
Sec. 15-3006 . Access , safety requirements
prerequisite to permit.
No permit shall be issued for a gasoline
service station or bulk :storage plant here-
after erected in the city, until the following
conditions and requirements have been
complied with:
(a) Access to stations or plants fronting on
two streets . For service stations or
bulk storage plants located on property
fronting on two (2) intersecting
streets the maximum access driveway
width measured at the street curb
line shall not be more than thirty-
five (35) feet. The curb opening is
to be not less than fourteen (14)
feet from the property line measured
at the property lines of the two (2)
intersecting streets.
(b) Access to stations or plants fronting on
one street. For service stations, or
bulk storage plants on property fronting
on one street only, the maximum access
driveway width measured at the street
curb line for each individual driveway
shall be thirty-five (35) feet, and
the total access driveway width to said
station or plant measured at the street
curb line shall not exceed seventy (70)
feet, except when pump islands are other
than parallel to the curb line the
maximum total shall be one hundred five
(105) feet. The curb opening to be not
less than five (5) feet from the
property line at the sidewalk line.

(c) Stations , plants where service parallel
to street line. For service stations
or bulk storage plants in which service
to motor vehicles is parallel to the street
line, the service pump, or pump island
shall be located not less than twelve
(12) feet from the street line and no
part of the vehicle or its load shall
extend within the street line. There
shall be a concrete curb four (4)
inches or more in height at the property
line parallelto the pump island and
extending the full length of the pump
island.
(d) Service at other than parallel to street
line. For service stations having
pumps or pump islands servicing motor
vehicles at other than parallel to the
street line, the service pumps shall be
not less than twenty (20) feet from any
street line.
(e) Accessory appliances . No accessory
appliance servicing motor vehicles shall
be nearer than two (2) feet to the
property line .

Division 2 . Regulations
Sec. 15-3017. Applicability to service
stations , tank vehicles .
This division applies to all service
stations and tank vehicles handling flammable
liquids as hereinafter defined within the city,
except that it does not apply to the trans-
portation of flammable liquids within the city
when in conformity with U. S. Interstate
Commerce Commission regulations or regulations
lawfully on file with and approved by the
Interstate Commerce Commission.
Sec. 15-3015 . Definitions .
For the purpose of this division the following
words and terms shall have the meaning ascribed
to them in this section.
(1) Bulk plant means that portion of property
when flammable liquids are received by
pipelines , tank cars , or tank vehicle
and are stored in bulk for the purpose
of distributing such liquids by tank
vehicle, pipeline , tank car or con-
tainer.
(2) Cargo tank means any container having
a liquid capacity in excess of one
thousand (1, 000) gallons, used for
carrying flammable liquids , and
mounted permanently or otherwise on a
tank vehicle.
(3) Chief means the chief of the city fire
department or any member of such de-
partment deputized for the purpose of
this division.

(4) Closed container means a container so
sealed by means of a lid or other device
that neither liquid or vapor will
escape from it at ordinary tempera-
tures .
(5) Flammable liquid means any liquid having
a flash point at or below twenty-five
degrees (25°) Fahrenheit (minus four
degrees (-4°) centigrade) as determined
by Elliott, Abel or tag closed cup tester.
(6) Safety can means an approved closed
container of not over five (5)
gallons capacity .
(7) Service station means that portion of
private property where flammable liquids
used as motor vehicle fuel are stored
and dispensed from fixed equipment
into fuel tanks of motor vehicles .
( 8) Tank vehicle means any single, self-
propelled motor vehicle equipped with
a tank mounted thereon or on a trailer
or semi-trailer.
Sec . 15-3019 . Service stations to be separated
from bulk plants .
Service stations dispensing flammable liquids
to the public shall not be located at a bulk
plant unless separated by a fence or similar
barrier from the area in which the bulk plant
operations are conducted.
Sec. 15-3020 . Facilities in streets prohibited.
It is unlawful for any person to erect,
operate or maintain any curb pump or other
facility or device used either in dispensing
flammable liquids or in the servicing of motor
vehicles , within the limits of any street,
avenue, or alley within the city.
Sec. 15-3021. Vehicles not to extend into
streets .
No part of any motor vehicle, or its load
shall project within the limits of any street,
avenue , highway or alley while such vehicle
is being serviced or remains standing upon the
property occupied by such service station or
bulk plant. The provisicns of this section
do not apply to service stations or bulk
plants existing on the effective date of this
chapter. In the event such service stations
or bulk plants are remodeled, they shall
comply with the requirements specified herein.
Sec. 15-3022 . Types of pumps , hoses , lighting
apparatus.
All pumps , filling hose and lighting apparatus
of any service station shall be of a type
approved by the American Insurance Association
or other nationally recognized fire prevention
agency for such installation.
Sec. 15-3023 . Fire extinguishers at service
stations.
All service stations .shall be equipped with
not less than one ten (10) pound dry power or
carbon dioxide (CO2) fire extinguisher, kept
in operating condition at all times , and
in a location readily accessible in case of
fire.
Sec. 15-3024 , Smoking prohibited; signs
required.
There shall be no smoking on the driveway of
service stations in areas used for fueling
motor vehicles , dispensing flammable anti-
freeze or the receipts of: products by tank
truck, or in those portions of buildings
used in servicing internal combustion engines .
Conspicuous signs prohibiting smoking shall
be posted within sight of customers being
served.
Sec. 15-3025 . Running motor while fueling
prohibited.
The motors of all vehicles being fueled
shall be shut off during fueling operations.
Sec. 15-3026 . Condition of tank vehicles .
Tank vehicles shall not be operated unless
they are in proper repair. , devoid of accumu-
lations of grease, oil or other flammables
and free of leaks .
Sec. 15-3027 . Fill, discharge of tank vehicles.
(a) The driver, operator or attendant of
any tank vehicle shall not leave the vehicle
while it is being filled or discharged.
Delivery hose when attached to a tank vehicle,
shall be considered to be a part of such
vehicle. Motors of tank vehicles shall be
shut down while unloading flammable liquid
and all unloading into service station under-
ground tanks from tank vehicles shall be by
gravity flow and not by pumping.
(b) An operator while unloading who permits
the discharge of flammable liquids to flow
on the surface of station grounds , sidewalk,
or public street or alley is guilty of a mis-
demeanor.
Sec. 15-3028. Sealed filler connections required.
Any tank vehicle discharging flammable
liquids into storage tanks shall employ a
sealer filler connection which provides
constant electric conducting contact between
the filler pipe and the tank vehicle .
Sec. 15-3029 . Provisions for expansion of
contents of tank vehicle .
In every cargo tank or compartment of any
tank vehicle sufficient space shall be left
vacant to prevent leakage or distortion by
expansion of the contents due to a rise in
temperature in transit. No cargo tank or
compartment shall be loaded to a volume in
excess of ninety-nine and one-half percent
(99 1/2%) of its capacity.

Sec . 15-3030 . Parking of tank vehicles.
No cargo tank vehicle which has , or within
twenty-four (24) hours immediately preceding
has had, a cargo of flammable liquid, shall
be left standing unattended on any street,
alley, highway, or other public property , nor
any parking lot open to the public as a place
for parking vehicles; provided that such
vehicles , when properly parked, may be left
standing for periods not exceeding one hour in
specific locations on streets within the city,
designated by the chief of police.
Sec. 15-3031 . Reserved.
Sec. 15-3032 . Emergency unloading of vehicles .
In the event an emergency requires the unloading
or discharge of a flammable liquid from any
tank or tank vehicle on a public street or
highway the fire chief shall be notified and
such operation shall not be commenced until
such necessary safeguard; as he shall require
have been established.
Sec. 15-3033 . Unloading vehicle during service
station operation.
No service station shall conduct its regular
business operations while a tank vehicle is
discharging flammable liquid on the premises
if such tank vehicle is located in a position
that will interfere with the unrestricted flow
of the normal business traffic of the service
station.
Section 2. All other ordinances and parts of ordinances
in conflict herewith are hereby repealed to the extent of such
conflict.
Section 3 . This ordinance is in full force and effect
from and after its adoption and publication as provided by law.
