Re: 1973 Alley Vacating Procedural Defect
Dear Mayor Curtis and Council Members:
In March of 1973, an unopened alley in the vicinity of South Walnut and South
4th Street was vacated by an ordinance declaring the intention that the land
be deeded to abutting owners. The deeds were issued, however procedurally it
was necessary to have resolutions passed authorizing the deeds. Those reso-
lutions were not enacted, although it is clear from the ordinance that the
Council intended the deeds to be issued. To correct the title examiner's
objections, the Council is asked to enact today the resolutions that should
have been adopted 21 years ago. The actual instruments are being prepared by
the attorney for the party making the title objections. These instruments
have not yet been received but will be placed before the Council at it's
meeting on March 1st. A copy of the 1973 ordinance is attached for your
information.
