HomeMy WebLinkAbout~Master - Amending Chapter 31 of Municipal Code (Encroachments, Pavement Repair) ORDINANCE NO. 2429 AN ORDINANCE AMENDING CHAPTER #31 OF THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA; REPEALING SECTIONS 31-2004, 31-3008; AND 31-5012; ESTABLISHING NEW SECTIONS 31-2004, 31-3008, AND 31-5012 ; ESTABLISHING A FEE FOR ENCROACHMENT PERMITS, A SCHEDULE OF CHARGE FOR REIMBURSEMENT TO THE CITY FOR CUTS INTO STREETS AND STREET APPURTENANCES, CURB CUTS AND CULVERTS, ALSO FEES FOR PERMITS FOR THE CONSTRUCTION AND RECONSTRUCTION OF SIDEWALKS ; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE. IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA Section 1. Sections 31-2004,, 31-3008 and 31-5012 of the Municipal Code of the City of Ames, Iowa, as hitherto existing are hereby repealed. Section 2. New sections to be numbered 31-2004, 31-3008 and 31-5012 are hereby added to the Municipal Code of the City of Ames, Iowa, as follows : Sec. 31-2004. Issuance of encroachment permit; records. Upon approval of an application for an encroachment permit by the city council the city clerk shall, upon filing of a bond, if required, collect the payment of a minimum fee of twenty-five dollars ($25.00) or one dollar ($1.00) per square foot of encroachment, which- ever is the larger amount, and issue the permit and retain a record thereof in his office. The permit as issued shall set forth in detail any requirements im- posed by the city council in granting the permit. Sec. 31-3008. Schedule of charges . The charges to be made for reimbursing the city for the cost of repair and maintenance of pavement and appurtenance cuts are based on the schedule of charges as set out herein. The schedule of charges does not include the cost of making the initial cut. (a) Paved strees or alley, replacements. For cuts made into or through paved streets or alley replace- ments in place one year or less , a charge shall be made of three dollars ($3.00) per square foot of surface cut, with a minimum charge of fifty dollars ($50.00) . For cuts into or through paved streets or alleys in place more than one year, a charge shall be made of one dollar fifty cents ($1. 50) per square foot of surface cut, with a minimum charge of twenty dollars ($20.00) . (b) Backfilling in streets and alleys . For cuts made within streets and alleys requiring backfilling a charge shall be made at the following rates : 0 to 100 cubic feet--10jZ per cubic foot 100 to 1, 000 cubic feet--4,(� per cubic foot Over 1, 000 cubic feet--3�4_ per cubic foot Minimum charge--$10. 00 Where one continuous ditch is dug in the street to serve properties on each side of the street, the charge herein for each property so served shall be computed from the center of the street. (c) Street appurtenances. For cuts made into or through street appurtenances a charge shall be made of two dollars ($2.00) per cubic foot with a minimum charge of eight dollars ($8. 00) . (d) Replacing gravel and stone surfaces. Existing gravel and stone surfaces which require replacement due to service or other surface cuts will be replaced by the city. A charge of ten cents (10i) per square foot will be made for the work with a minimum charge of ten dollars ($10. 00) . (e) Curb openings. A charge of five dollars ($5. 00) per opening shall be made for all applications for residential curb openings or changes in width or loca- tion of any existing residential access drive, except that there shall be no charge for the initial curb opening for any lot or tract of land for which a building permit is issued in accordance with the standard practices. A charge of twenty dollars ($20. 00) shall be made for all applications for commercial or industrial curb openings or access permits and any application for any type of curb opening or access permit to a primary highway. There shall be no charge for any curb opening made incident to street construction or reconstruction. (f) Driveway culvert installation. Driveway culverts shall be furnished and installed by and remain the property of the city. The owner of the property to which access is provided by the culvert shall be charged a fee of one dollar fifty cents ($1. 50) per linear foot of culvert used. Sec. 31-5012. Permit fees, staking and restaking. The fee for a permit to construct or reconstruct a sidewalk shall be two dollars ($2 . 00) for each lot. The city upon request, and payment of an additional fee, will place stakes to delineate the area and grade for the construction of the sidewalk. Where the curb and gutter have been installed at established grades, the additional fee shall be three dollars ($3.00) for each lot. Where the street has not been paved and the gutters have not been constructed at established grades, the additional fee shall be nine dollars ($9.00) for each lot. The fee for any requested restaking shall be the same as for an initial staking. Section 3 . All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4.
