HomeMy WebLinkAbout~Master - Amending Chapter 36 of Municipal Code; Relating to Resodding ORDINANCE NO. 2396 AN ORDINANCE AMENDING CHAPTER #36 OF THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA; ESTABLISHING NEW SECTIONS DESIGNATED 36-1003 and 36-1004; ESTABLISHING RESPONSIBILITY AND THE CHARGE FOR RESODDING ACCOMPLISHED BY THE CITY INCIDENT TO EXCAVATION FOR UTILITIES ; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE. IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA: Section 1. New sections to be numbered 36-1003 and 36-1004 are hereby added to the Municipal Code of the City of Ames, Iowa, as follows : Sec. 36-1003 . Resodding by responsibile property owner. A property owner excavating or causing excavation in the lawn or the parking of a neighboring residence in a developed residential area, for the purpose of installing or repairing a utility line within a city easement shall resod the disturbed area. Sec . 36-1004. City to resod. Upon complaint of failure of the responsible party to resod a disturbed area pursuant to either Section 36-1002 or 36-1003, and after ten (10) days notice to the responsible party, the City shall do the resodding and shall charge the responsible party (other than a municipal utility) at the rate of one dollar fifty cents ($1.50) per square foot. Section 2 . All ordinances and parts of ordinances in con- flict herewith are hereby repealed to the extent of such conflict. Section 3 . This ordinance is in full force and effect from and after its passage and publication as provided by law. Adopted this 18th day of April 1972.
