LOCATION: Southwest corner of West Lincoln Way and South Dakota Avenue. LEGAL DESCRIPTION: The North Half of the Northeast Quarter (N-1/2 NE-1/4) of Section 7, Township 83 North, Tange 24 West of the 5th P.M. , Story County, Iowa, subject to roads and highways. BY: Erben A. Hunziker and Donald M. Furman. HISTORY: The northeast fourteen acres were requested for rezoning to "C-3," Highway Commercial District, by James H. Anderson, at the July 16, 1971 , meeting; the request was denied by both the Commission and Council . COMPREHENSIVE The Comprehensive Plan designates the area as a combin- PLAN REFERENCE: ation of low-density and medium-density residential . REPORT: The request for rezoning is as shown on the proposed plat of the area. This reference is due to the fact that the tract cannot be platted unless proper zoning is obtained. The rezoning then is in relation to the outlined streets and lot lines. Upon zoning approval , the developer would be directed to proceed with platting. The over-all layout is proper and has undergone many modifications since the original was submitted to the Planning office. The "protected waterway" transversing the tract is as approved in concept by the Commission at a recent joint meeting with the Park Board. A letter from the Park Board stating approval is attached. It is the recommendation of the staff that the request as presented on the proposed plat be approved and so recommended to City Council , and upon approval the developer be directed to proceed with platting.
