HomeMy WebLinkAbout~Master - Amending Chapter 28 of Municipal Code; Relating to Collection of Sewer Fees p p Fee $4. 50 f`0002 !� 11WCITY ORDINANCE NO. 2378 N ORDINANCE AMENDING CHAPTER #28 OF THE MUNICIPAL CODE OF THE OF AMES, IOWA, REPEALING SECT_=ONS 28-1004 . 12 AND 28-1004. 14; ENACTING NEW SECTIONS 28-1004 . 12 AND 28-1004. 14 ; PROVIDING FOR THE COLLECTLON OF SEWER CONNECTION FEES WITH REGARD TO PROPERTIES WHICH DID NOT CONTRIBUTE TO THE COSTS OF CONSTRUCTING THE SEWER; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HERE- WITH AND ESTABLISHING AN EFFECTIVE DATE. IOWA: IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, Section 1. Sections 28-1004 . 12 and 28-1004 .14 of the Municipal Code of the City of Ames , Iowa, as hitherto existing are hereby repealed. Section 2. New sections to be numbered 28-1004. 12 and 28-1004. 14 are hereby added to Chapter #28 of the Municipal Code of the City of Ames , Iowa, as follows : Sec. 28-1004. 12. Noncontributors ; sanitary sewer connections. Upon completion of the construction of any extension or addition to the sanitary sewer system, not installed under special assessment proceedings and not within a sanitary sewer district created by an ordinance which establishes connection fees for nonassessed or noncontributing areas , the city manager shall prepare a plat of the areas served by such extension and shall designate thereon the areas , if any, that did not participate in the construction costs of said sewer extension. A certified copy of such plat shall be filed in the office of the county recorder. Sec. 28-1004. 14. Sewer connection fee; noncontributors. Upon the issuance of a plumbing fee to service any of the noncontributing areas as defined in Sec. 28-1004 . 12 , a sewer connection fee of $2. 50 per foot of property to be served or a minimum fee of $200. 00 shall be collected before such connection is made. Upon the issuance of a plumbing permit to service any noncontributing area or parcel within a sanitary sewer district established by ordinance, a connection fee shall be collected in accordance with the schedule of connection fees established in such ordinance. All connection fees shall be collected in addition to other charges or inspection fees herein provided. All connection fees collected shall be kept in a separate and distinct par of the sanitation fund, to be known as the "Sewer Connection Fund" , and shall only be disbursed and used for purposes authorized by Sec. 393 . 7 , 1971 Code of Iowa. Section 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4.
