WHEREAS , heretofore and in strict compliance with Chapter (j391A Code of Iowa, this Council did, pursuant to Resolution of Necessity duly adopted, order the construction of Sanitary Sewer �'land Water Main Project No. 1 , 1971, Division I of which established� the Terminal Points and Assessment Boundary for the Timberland (! Heights Sanitary Sewer; and I�� WHEREAS , in due course the work has been performed and t accepted for said Division I , for a total cost found and determined by Resolution No. 6040 adopted Octcber 5 , 1971, to be $78 ,950. 41; end WHEREAS b i y Resolution No. 6040 adopted October 5 , 1971, ! this City Council assessed proportionate costs of the Tii.-be-rland Heights Sewer project in the amount of $26 , 864 . 30 against those lots and plots which had been incorporated into the City of Ames; and WHEREAS, the normal! assessable but unassessed I Y cost of 'Isuch ,improvement, being in the amount of $24 ,300 . 84 with interest from January 1 , 1972, should be born by the unincorporated and nonassessed lots and plots located within Assessment Boundary for said Timberland Heights Sanitary Sewer Assessment District. Now therefore, IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF ADES, IOWA as follows : I� Section 1. The territory and real estate previously ! described and defined as the Timberland Heights Sanitary Sewer Assessment District is hereby further established and designated as the Timberland Heights Sanitary Sewer District, the boundaries lof which are as follows : I "Beginning at the Southeast corner of Lot 1 Reiste' s ` Timberland Heights Subdivision to the City of Ames , Iowa, ( thence North along the East :Line of Reiste' s Timberland Heights Subdivision and Christensen' s Timberlane Subdivision to the Northeast corner of Lot 9 Christensen' s Timberlane ji Subdivision, thence Westerly and Southerly along the North liand West line of Christensen' s Timberlane Subdivision to the Southwest corner of Lot 2 Christensen' s Timberlane Subdivision, �I thence West to a point 170 . 7 feet South and 1316 . 1 feet West li of the center of Section 16 , Township 83 North, Range 24 West, thence South O°11' East- 1295. 5 feet to the centerline (I of County Road, thence Easterly along the centerline of (� County Road to a point 33 feet South of the Southwest corner of Lot 24 Reiste' s Timberland Heights Subdivision, thence North to the said Southwest corner Lot 24 , thence Easterly I; to the point of beginning. Heights Sanitary Sewer District is described as follows : i ( "Beginning at an existing manhole (Sta. 42+64. 31) in Worle (� Creek Outfall, thence Southeasterly and Southwesterly to a �i point in Timberland Road, 790. 88 feet from the beginning. i� Also starting at a manhole at: Sta. 6+80 . 88 said line and running Westerly 75 . 0 feet. Also beginning at an existing manhole (Sta. 54+95. 25) in Worle Creek Outfall, thence Southerly , Easterly, Northerly and Easterly to a point in Timberland Road 1090. 0 feet from beginning, thence continuing i� Southerly in Timberland Road 928 . 5 feet. Also starting at 1 j! Sta. 10+90 of said line and running Northerly in Timberland Road 630 .0 feet. Also starting at Sta. 17+98. 5 said line ! and running Westerly 178. 0 feet. Also beginning at Sta. 4+37 . 01 said line and running South and Southwesterly 411. 641 feet (all with an 8" vitrified clay pipe sanitary sewer) . °° i It I -2- I Section 3. The unassessed balance of the cost of the I subject improvement, being the amount of $24 , 300 . 84 with interest � at the rate of 7% per annum, effective January 1, 1972, shall be lirecouped from the nonassessed, noncontributing properties located ' within the said Timberland Heights Sanitary Sewer District by (! charging connection fees . Upon issuance of a plumbing permit to connect to the Timberland Heights Sanitary Sewer to service any of the nonassessed, noncontributing territory or real estate, ' hereafter incorporated into the City of Ames , a connection fee ( shall be collected with interest at 7% per annum from January 1, J11972, in accordance with the following schedule : I I !
