HomeMy WebLinkAbout~Master - Amending Chapter 28 of Municipal Code, Plumbing Ordinance ORDINANCE NO. 2354 AN ORDINANCE AMENDING CHAPTER #28 OF THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, REPEALING SECTIONS 28-1005. 10 , 28-1005. 11, 28-1101, 28-1101. 1, 28-1101. 3, 28-1101. 4, 28-2007 , 28-2011, 28-2014, AND 28-2020; ENACTING NEW SECTIONS 28-1005 . 10, 28-1005. 11, 28-1101, 28-1101. 1, 28-1101. 3, 28-1101. 4, 28-2006. 1, 28-2007 , 28-2011, 28-201.4 AND 28-2020; REQUIRING SEWER CONNECTIONS; PRE- SCRIBING REQUIREMENTS FOR SUBSOIL DRAINS AND BUILDING SUBDRAINS; PROVIDING FOR AN APPEAL FROM DECISIONS OF THE BOARD OF EXAMINV'RS; ESTABLISHING THE EXAMINATION FEE SCHEDULE AND LICENSING FEE SCHEDULE; AND MAKING VIOLATION OF THE PLUMBING ORDINANCE A MIS- DEMEANOR; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE. IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA: Section 1. Sections 28-1005. 10, 28-1005. 11, 28-1101, 28-1101. 1, 28-1101. 3, 28-1101. 4 , 28-2007 , 28-2011, 28-2014, and 28-2020 of the Municipal Code of the City of Ames , Iowa, as hitherto existing are hereby repealed. Section 2. New sections to be numbered 28-1005. 10, 28-1005. 11, 28-1101, .28-1101. 1, 28-1101. 3, 28-1101. 4, 28-2006. 1, 28-2007, 28-2011, 28-2014 and 28-2020 are hereby added to Chapter #28 of the Municipal Code of the City of Ames , Iowa, as follows : Sec. 28-1005. 10. Sewer required. Every building in which plumbing fixtures are installed shall have a connection to a public sewer, except as provided in Section 28-1005. 11. Sec. 28-1005. 11. Private sewage disposal system. When a public sewer is not available for use, sewage and drainage piping shall be connected to an individual sewage disposal system found to be adequate and of an approved design as recommended by the Iowa State Depart- ment of Health in Appendix B Iowa State Plumbing Code 1964. A plan showing the location and design of the septic tank and secondary disposal system and also the location of wells within 75 feet of the site shall be filed with the application for a plumbing permit, and a copy of such plan shall be furnished to the owner. However, sewage piping must be connected to a public sanitary sewer within one year after such sewer becomes available. Sec. 28-1101. Drainage required. Roofs, paved areas , yards, courts and courtyards may be drained into a storm sewer system, either under- ground or by surface gravity flow. Sec. 28-1101. 1. Prohibited drainage. Storm water from roofs, paved areas , yards, courts, courtyards, area drains or subsoil drains shall not be drained into sewers maintained for sewage. Sec. 28-1101. 3. Subsoil drain. Where subsoil drains are placed under the cellar or basement floor or are used to surround the outer walls of a building, they shall be made of open-jointed or horizontally split or perforated clay tile or cement tile not less than 4 inches in diameter. They shall be a part of the building storm drain or be discharged into a properly designed sump. (See Sec. 28-1101. 4) -2- Sec. 28-1101. 4. Building subdrains. Building subdrains located below the public sewer level shall be discharged into a sump or receiving tank. Such sump and the sump permitted in Section 28-1101. 3 shall be constructed substantially in compliance with the plans and specifications on file in the office of the plumbing inspector and the contents of such sump shall be automatically lifted and discharged to the outside of the building. Sec. 28-2006. 1. Appeals from board. In the event any person feels aggrieved by any action of the board, he may appeal from such action to the city council by filing a written notice of his appeal within ten (10) days from the date of action. The council shall give the appealing party and the examining board five (5) day' s written notice by certified mail of the date, time and place of hearing. All interested persons shall be given an opportunity to be heard at such hearing and the city council may affirm, modify, or overrule the action of the board. Sec. 28-2007 . Application for license required; examination fee. Each applicant for a license either as a journeyman or master plumber shall fill out and file with the secretary of the board an application for such license on forms furnished by the secretary, shall pay at the office of the city clerk an examination fee of fifteen dollars ($15. 00) for journeyman plumbers and fifteen dollars ($15. 00) for a master plumber and shall report for examination at the time and place fixed by the board. Sec. 28-2011. Reexamination after failure. If the applicant for a license hereunder fails to qualify upon examination, he may be reexamined after one hundred and eighty (180) days, but not more than two hundred and seventy (270) days , without payment of an additional examination fee. Sec. 28-2014. Licenses not transferable; expiration, renewal; fee. Licenses are not transferable and shall expire on the thirty-first day of December of each year. Licenses may be renewed upon payment of an annual license fee at the office of the city clerk of five dollars ($5. 00) for a journeyman plumber and ten dollars ($10 . 00) for master plumber. Failure to renew a license before expiration date may subject the person to a new examination. Sec. 28-2020. Violations. Any person, other than a licensed plumber or as provided in Section 28-1004. 2A, who engages in or does plumbing work in the city without first having obtained a license as herein provided for, is guilty of a misdemeanor. Section 3 . All ordinances or parts of ordinances in conflict herewith are hereby repealed. -3- Section 4.
