HomeMy WebLinkAbout~Master - Amending Chapter 32 of Municipal Code; Relating to Platting of Subdivisions r , i ij I ORDINANCE NO. 2343 I, IAN ORDINANCE AMENDING CHAPTER #32 OF THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, REPEALING SECTIONS 32-1001 AND 32-1014; ENACTING II NEW SECTIONS TO BE NUMBERED 32-100.1 AND 32-1014 ; REQUIRING PLATT 1JNG OF SUBDIVISIONS WITHIN THE CITY AND. WITHIN TWO MILES OF THE CORPORATE LIMITS AND LISTING DOCUMENTS TO BE FILED PRIOR TO APP- ROVAL OF A PLAT; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE. I IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA: Section 1. Sections 32-1001 and 32-1014 of the Municipal Cod of the City of Ames , Iowa, ashitherto existing are hereby repealed. Section 2. New sections to be numbered 32-1001 and 32-1014 are hereby added to the Municipal Code of the City of Ames, Iowa, as follows : Sec. 32-1001. Platting required; scope of chapter. (a) Every original proprietor of any tract or parcel of land within the city or within two miles of the corporate limits thereof, who has subdivided or shall hereafter sub- divide the same into three (3) or more parts, for the pur- pose of laying out a town or city, or addition thereto or part thereof, or suburban lots , shall cause a registered land surveyor' s plat of the subdivision or area to be made by a registered land surveyor holding a certificate under the laws of the state in the form and containing the in- formation hereinafter set forth. The plat shall be sub- mitted to the city council and approved by the council fbefore being made a matter of official record. (b) As the city has a population of over twenty-five thousand (25,000) by the latest federal census, and has a plan commission organized under the laws of Iowa, this chapter applies to all plats of areas within two miles of the corporation limits of the city. All form, content and procedural requirements in this chapter contained applies to the plats. The city council may require as a condition of approval of the plats that the owner of the land bring the streets to a grade acceptable to the council and comply with such other reasonable requirements in regard to installation of public utilities, or other requirements in this chapter contained, as the city council, with the recommendation of the city plan commission, may I' deem requisite for the protection of the public interest. Sec. 32-1014. Owner to file documents prior to approval I of plat. The owner of the land being platted shall have on file with the city clerk not less than seven (7) days prior to consideration by the city council of the final accept- ance of the plat the following plats, documents and in- formation in the forms and number of copies as hereinafter specified: (a) Sixteen (16) copies of the final plat. (b) Three (3) copies of all easements for utility or other purposes . -2- { ( (c) Four (4) copies of a proposed resolution to be adopted by the city council approving the final plat and accepting lands to be dedicated for public use. (d) Three (3) copies of an agreement to be entered i into between the owner and the city providing for the grading of streets and installation of a sanitary sewer system and other utilities or improvements as may be required. Section 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 4.
