ORDINANCE NO . 2325
AN ORDINANCE REPEALING CHAPTER #25 OF THE MUNICIPAL CODE OF THE
CITY OF AMES , IOWA; ESTABLISHING A NEW CHAPTER #25 ENTITLED ,
PARKS AND RECREATION ; DEFINING ACTS PROHIBITED IN PUBLIC PARKS
AND RECREATION FACILITIES ; PROVIDING FOR A PARK COMMISSION, ITS
COMPOSITION, ORGANIZATION , POWERS AND DUTIES ; PROVIDING FOR A
RECREATION COMMISSION , ITS COMPOSITION , ORGANIZATION , POWERS
AND DUTIES ; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES
IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE .
IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES , IOWA•
Section 1 . Chapter #25 of the Municipal Code of the City
of Ames , Iowa , as hitherto existing is hereby repealed .
Section 2 . A new Chapter #25 of the Municipal Code of the
City of Ames , Iowa, is established as follows :
CHAPTER #25-PARKS AND RECREATION
ARTICLE 1 . IN GENERAL
Sec . 25-1001 . Damaging plants , property in parks and
recreational facilities . It is unlawful for any person
to willfully cut , rake , damage , destroy or interfere with
any trees , shrubs , flowers , bush or other planting , or
building , structure , or other facility in any public park
or recreation facility of the City of. Ames .
Sec . 25-1002 . Unlawful to operate motor vehicles in
City Park; exceptions . It is unlawful for any person
to operate a motor vehicle as defined in the laws of
the State in any public park of the city , except upon
the streets therein and parking areas specifically
designed for motor vehicle travel , and except as may be
specifically authorized by the park board.
Sec . 25-1003 . Firearms prohibitedi exceptions . Except
for police officers , while on duty , and as otherwise
specifically approved by the park board or the recreation
commission , it is unlawful for any person to carry or
have in his possession or under his control in any public
park or recreation facility of the City of Ames , any fire-
arm of any description whatsoever , BB-gun, pellet-gun , bow
and arrow , slingshot , or any other device that throws
or shoots a projectile of any kind .
Sec . 25-1004 . Unlawful to violate rules and regulations .
It is unlawful for any person to violate rules and reg-
ulations promulgated by the park board or by the rec-
reation commission and posted in a public park or other
recreation facility of the City of Ames under the control
or supervision of the said board or commission .
Sec . 25-1005 . Co-operation and mutual support . The park
board and recreation commission shall co-operate with each
other , other departments of the city , and the superintenden
of schools and shall receive the support of other depart-
ments of the city in the government and operation of the
public parks , playgrounds , and recreation facilities .
ARTICLE II-PARK BOARD
Sec . 25-2001 . Membership ; residence requirements . The
park board consists of three (3) commissioners elected
from the city at large . Each commissioner shall be a
resident of the city and at least one commissioner shall
be a resident of Washington Township and one a resident
of Franklin Township .
Sec . 25-2002 . Election of commissioners ; term of office .
One park commissioner shall be elected at each general
city election for a term of six (6) years .

Sec . 25-2003 . Organization, quorum. The park board
shall at its first meeting in January of each year
elect one of its members as chairman and one member
as secretary . Two (2) members shall be necessary
to constitute a quorum.
Sec . 25-2004 . Funds ; accounting ; receipts ; disbursements .
Account procedures , payroll and financial reports and
other financial operations shall be in accord with the
directions and instructions of the Director of Finance .
All monies collected by or on behalf of the park board
shall be turned in to the Finance Department and dis-
bursements will be by that department on orders approved
by the chairman and secretary of the board.
Sec . 25-2005 . Powers and duties . The park foard has the
following powers :
(a) Acquisition of real estat,: . The park board
may acquire real estate within or without the city for
park purposes by donation , purchase or lease . Any
condemnation action necessary to acquire land will be
approved Dy the _-Lt-,, c,-uncil .
(b) Disposal of real estate . The park commission
may sell , subject to the approval of the city council ,
exchange or lease any real estate acquired by it which
shall be found unfit or not desirable for park purposes .
(c) Lease to organizations . The park board has
authority to lease under reasonable rules and require-
ments a particular park or portion thereof , under its
jurisdiction , for a period not in excess of ten (10) days
to charitable , fraternal , or patroitic organizations , for
the purpose of permitting such organizations to conduct
celebrations , ceremonies and enterainment . It may also
lease under reasonable rules and regulations such parks
or portions thereof under its jurisdiction for such time
or times , not to exceed six (6) consecutive months , as
the board deems proper , for the playing of professional
baseball or other professional games and may charge fees ,
as the board shall determine , for the use of the park or
parks .
(d) Territorial jurisdiction . The park board shall
have jurisdiction over all lands used for parks within
or without the corporate limits of the City of Ames , and
all ordinances of the city shall be in full force and
effect in and over the territory occupied by the parks .
Sec . 25-2006 . Annual budget required ; source of revenue .
The park board shall on or before July lst of each year
prepare and submit to the City Manager a detailed budget
showing the proposed expenditures for the following fiscal
year . All salaries and expenses incurred in the mainten-
ance of the public parks shall be paid from the park fund
of the city .
ARTICLE III-RECREATION COMMISSION
Sec . 25-3001 . Composition. The Recreation Commission, as
of December 31 , 1969 , consists of nine (9) members . As of
April 1 , 1970 , the Recreation Commission shall consist of
six (6) members and as of April 1 , 1971 , the Recreation
Commission shall consist of five (5) members . Vacancies
arising in terms due to expire on or before dates set
forth above will not be filled .
Sec. 25-3002 . Appointment ; qualifications ; compensation;
term of office . The members of the Recreation Commission
shall be appointed by the Mayor with the approval of the
council , and all members shall be qualified electors of
the city and serve without compensation . The term of
office of each member is three (3) years . Members shall
not be reappointed more than one (1) time . Terms of
office begin on April 1st of the year in which the
appointment is made .
Sec . 25-3003 . Organization. The Recreation Commission
shall at its first meeting in April of each year elect
one of its members as chairman and one member as secretary .
Two (2) members shall be necessary to constitute a quorum.

Sec . 25-3005 . Duties and responsibilities . The Recreation
Commission is responsible for the maintenance and control
of the recreation equipment and facilities and for plann-
ing , organizing and supervising of the recreation program
for the City of Ames .
Sec . 25-3006 . Annual budget required ; source of revenue .
The Recreation Commission shall on or before July 1st of
each year prepare and submit to the City Manager a detailed
budget showing the proposed expenditures for the following
fiscal year . All salaries and expenses incurred in the
recreation program and maintenance of the recreation
facilities shall be paid from the recreation fund of the
city .
Section 3 . All ordinances and parts of ordinances in con-
flict herewith are hereby repealed .
Section 4 . This ordinance is in full force and effect from
And after its passage and publication as provided by law .
