AN ORDINANCE REPEALING CHAPTER 30 OF THE MUNICIPAL CODE OF THE
CITY OF AMES, IOWA, AND ESTABLISHING A NEW CHAPTER 30 DESIGNATED
RESTAURANTS, FOOD ESTABLISHMENTS AND FOOD SERVICES ; ARTICLE It
DESIGNATED FOOD SERVICE SANITATION, DEFINING FOOD, POTENTIALLY
HAZARDOUS FOOD, ADULTERATED, MISBRANDED, FOOD-SERVICE ESTABLISH-
MENT, TEMPORARY FOOD-SERVICE ESTABLISHMENT, HEALTH AUTHORITY,
UTENSILS, EQUIPMENT, ETC. ; PROVIDING FOR THE SALE OF ONLY UNADUL-
TERATED, WHOLESOME, PROPERLY BRANDED FOOD; REGULATING THE SOURCES
OF FOOD; ESTABLISHING SANITATION STANDARDS FOR FOOD, FOOD PROTEC-
TION, FOOD-SERVICE PERSONNEL, FOOD-SERVICE OPERATION, FOOD EQUIP-
MENT AND UTENSILS, SANITARY FACILITIES AND CONTROLS, AND OTHER
FACILITIES ; REQUIRING PERMITS FOR THE OPERATION OF THE FOOD-SERVICE
ESTABLISHMENTS ; REGULATING THE INSPECTION OF SUCH ESTABLISHMENTS ;
I PROVIDING FOR THE EXAMINATION AND CONDEMNATION OF FOOD; PROVIDING
FOR INCORPORATION BY REFERENCE OF THE 1962 EDITION OF THE "UNITED
STATES PUBLIC HEALTH SERVICE FOOD SERVICE SANITATION ORDINANCE AN
CODE"; AND PROVIDING FOR THE ENFORCEMENT OF THIS ARTICLE AND FIX-
ING PENALTIES ; ARTICLE II, DESIGNATED VENDING OF FOOD AND BEVERAGE ,
REGULATING THE SALE OF FOOD AND BEVERAGES THROUGH VENDING MACHINES;
DEFINING VENDING MACHINE, OPERATOR, HEALTH AUTHORITY, AND OTHER
TERMS ; REQUIRING PERMITS FOR THE INSTALLATION AND OPERATION OF
VENDING MACHINES ; PROHIBITING THE SALE OF, OR POSSESSION WITH
INTENT TO SELL THROUGH VENDING MACHINES, ADULTERATED OR MISBRANDED
FOOD OR DRINK REGULATING MAINTENANCE AND OPERATION OF VENDING
MACHINE; AUTHORIZING OFFICIAL INSPECTION OF VENDING MACHINE AND
OPERATIONS CONNECTED THEREWITH; PROVIDING FOR THE INCORPORATION
BY REFERENCE OF "THE VENDING OF FOOD AND BEVERAGES - A SANITATION
ORDINANCE AND CODE" - 1965 RECOMMENDATIONS Ox' THE PUBLIC HEALTH
SERVICE; AND PROVIDING FOR THE ENFORCEMENT OF THIS ARTICLE AND
AFFIXING OF PENALTIES ; REPEALING ALL ORDINANCES AND PARTS OF
ORDINANCES IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE.
IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES,
IOWA:
Section 1. Chapter 30, "Restaurants and Food Establish-
ments " of the Municipal Code of the City of Ames, Iowa, as hither-
to existing is hereby repealed.
Section 2. A new chapter to be numbered Chapter 30 is her
added to the Municipal Code of the City of Ames , Iowa, as i
follows :

RESTAURANTS, FOOD ESTABLISHMENTS AND FOOD SERVICE
ARTICLE I
FOOD SERVICE SANITATION

Sec. 30-1001. Code adopted. Except as herein provided by '
specific changes, the 1962 Edition of "United States Public Health
Service Food Service Sanitation Ordinance and Code" is adopted byi
reference. Three (3) copies of which were filed prior to the j
adoption of thissection in the Office of the City Clerk for use !
of and examination by the public.
Sec. 30-1002. Word and phrase substitutions in Code. The
following word and phrase substitutions are made in the "United
States Public Health Service Food Service Sanitation Ordinance
and Code" wherever they appear:

Sec. 30-1003 . Section H of Code amended. The following
are understood to be deleted and inapplicable in the City of Ames,
Iowa: all parenthetical phrases referring to grading and sub-
sections H. 2 .e. , H. 7 . and H.8, and Part III, Section 3 .
Sec. 30-1004. Penalties . Any person who violates any of
the provisions of this Article shall be guilty of a misdemeanor.
Each day upon which such a violation occurs constitutes a separate
violation.
Sec. 30-1005. Public Nuisances . Violations of this Article
may constitute public nuisances and in addition to any action take
under Sec. 30-1004, may be abated in accordance with the provision
of Chapter 24 of the Municipal Code of the City of Ames, Iowa.
ARTICLE II
VENDING OF FOOD AND BEVERAGES
Sec. 30-2001. Code adopted. Except as herein provided by
specific changes, "The Vending of Food and Beverages - A Sanitatio
Ordinance and Code - 1965 Recommendations of the Public Health
Service" is adopted by reference and shall be known as the Code
for Vending of Food and Beverages. Three (3) copies of which were
filed prior to adoption of this section in the Office of the City
Clerk for use and examination by the public.
Sec. 30-2002 . Word and phrase substitutions in Code. The
following word and phrase substitutions are made in "The Vending
of Food and Beverages - A Sanitation Ordinance and Code - 1965
Recommendations of the Public Health Service" wherever they
appear:

Sec. 30-2003 . Subsection added. Subsection V. 13 is added
to the Code for Vending of Food and Beverage and shall read as
follows :
13 . Sandwiches shall bear upon the wrapper the date of
manufacture. All unsold sandwiches shall be removed from
vending machines before the third day following the date
of manufacture.
Sec. 30-2004. Section VIII of Code amended. Section VIII
of the Code for Vending of Food and Beverages is amended and shall
read as follows :
Section VIII. Commissaries outside jurisdiction of the
health authority. Food from commissaries outside the
jurisdiction of the health authority of the City of Ames
may be sold within the City of Ames if such commissaries
conform to the provisions of the food-service establishment
sanitation regulations of the City of Ames, or to substan-
tially equivalent provisions, provided, that any such
commissary must file with the City Clerk and keep current
a list of operators (with addresses) for whom food is
supplied for vending within the City of Ames . To determine
the extent of compliance with the provisions of the food-
service establishment sanitation regulations of the City
of Ames , the health authority may accept reports from
responsible authorities in the jurisdictions where the
commissary or commissaries are located.
Sec. 30-2005. Sections of Code Deleted. The following
sections of the Code are understood to be deleted and inapplicabl
in the City of Ames , Iowa: Section IX. Enforcement Interpretati n.
Section X. Penalty, and Section XI. Repeal and Date of Effect.

Sec. 30-2006. Penalties. Any person who violates any of

Sec. 30-2007. Public Nuisances. Violations of this Article

under Sec. 30-2006 , may be abated in accordance with the provisio s
of Chapter 24 of the Municipal Code of the City of Ames , Iowa.
Section 3. All ordinances and parts of ordinances in con-
flict herewith are hereby repealed.
Section 4 . This ordinance, after its passage and publica-
tion as provided by law, will be in full force and effect on
July 1, 1970.
