HomeMy WebLinkAbout~Master - Amending Chapter 3 of Municipal Code; Relating to Minors and Beer Establishments ORDINANCE NO.� 2285 AN ORDINANCE AMENDING CHAPTER 3 OF THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SECTIONS 3-2040, 3-2042, AND 3-2047 OF THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, ; ES- TABLISHING NEW SECTIONS TO BE NUMBERED SECTIONS 3-2040, 3-2042, AND 3-2047, MAKING THE MISREPRESENTATION BY A MINOR OF HIS OR HER AGE FOR THE PURPOSE OF ENTERING AN ESTABLISHMENT WHERE BEER IS SOLD, OR TO PURCHASE BEER A MISDEMEANOR; PROHIBITING MINORS ON THE PREMISES OF ESTABLISHMENTS WHERE MORE THAN FIFTY PERCENT OF THE BUSINESS IS THE SALE OF BEER OR INTOXICANTS ; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE. IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA: Section 1. Sections 3-204G, 3-2042, and 3-2047 of the Municipal Code of the City of Ames, Iowa, as hitherto existing are hereby repealed. Section 2. New sections to be numbered 3-2040, 3-2042, and 3-2047 are hereby added to the Municipal Code of the City of Ames, Iowa, as follows Sec. 3-2040. Minors misrepresenting age. No minor shall misrepresent his or her age for the purpose of entering and remaining upon a place of business where beer is sold as defined in Section 3-2042 of this Chapter or for purchasing, obtaining or attempting to purchase or obtain any alcoholic beverage or beer. If any minor misrepresents his or her age, and if the permit holder shall establish that he made reasonable inquiry to determine whether such person was a minor, the permit holder shall not be guilty of a misdemeanor. Sec. 3-2042. Minors prohibited on premises . It is unlawful for a person under twenty-one (21) years of age to be in, or for any person knowXingly to permit a person under the age of twenty-one (21) years to be in, a place where beer is sold unless at least fifty percent (50%) of the business conducted by the permit holder is other than the sale of beer or intoxicating beverages . The provisions of this section shall not apply to any person under the age of twenty-one (21) years who: a. Is accompanied by a parent, guardian or spouse who is twenty-one (21) years of age or older, or b. Is a regular employee of the permit holder while performing regular duties during the course of employment. Sec. 3-2047. When permit must be revoked. The permit under this chapter shall be automatically revoked and shall immediately be surrendered by the permit holder and the bond of the permit holder shall be forfeited upon any of the following events : a. If the permit holder is convicted of any violation of Subsection 3, 6 or 7 of Section 124. 20 Code of Iowa. -2- b. If the permit holder is convicted of any violation of Section 124.31 of the Code of Iowa. C. If any agent or employee of the permit holder is convicted of any violation of Subsection 3 of Section 124. 20 Code of Iowa in or about the place of business for which the permit is issued. d. If the permit holder is convicted of a felony. ° Section 3 . All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4. This ordinance is in full force and effect from and after its passage and publication as provided by law. Passed this 18th day of March __ Y ___� _ 1969.
