AN ORDINANCE REPEALING SECTION 3-2007 OF THE MUNICIPAL CODE OF THE
CITY OF AMES, IOWA, AND ENACTING A NEW SECTION TO BE NUMBERED
3-2007 , RELATING TO THE APPLICATION FOR CLASS "B" BEER PERMITS,
THE ISSUANCE OF SUCH PERMITS, AND PROVIDING FOR THE ISSUANCE OF
"PROVISIONAL PERMITS " IN CASES WHERE THE PLACE OR BUILDING WHERE
THE APPLICANT INTENDS TO OPERATE HAS NOT BEEN CONSTRUCTED AT THE
TIME THE APPLICATION IS MADE, OR IS OTHERWISE UNSUITABLE AS THE
LOCATION OF SUCH PERMIT, AT THE TIME OF APPLICATION, AND PROVIDING
FOR CONDITIONAL APPROVAL BY COUNCIL OF PROPOSED PLANS AND
REPRESENTATIONS BY THE APPLICANT; REPEALING ALL ORDINANCES AND PAR PS
OF ORDINANCES IN CONFLICT HEREWITH; AND ESTABLISHING AN EFFECTIVE
DATE.
IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES,
IOWA:
Section 1. Section 3-2007 of the Municipal Code of the
City of Ames , Iowa, as hitherto existing is hereby repealed.
Section 2. A new section to be numbered Section 3-2007
is added to the Municipal Code of the City of Ames , Iowa, and is
as follows :
Sec. 3-2007 . Issuance of Class "B" permits to individuals .
A Class "B" permit shall be issued to any individual who:
(a) Submits a written application for a permit which
application shall state under oath :
(1) The name and place of residence of the
applicant, and the length of time he has
lived at such place of residence.
(2) That he is a citizen of the State of Iowa
(3) The place of birth of the applicant, and
if the applicant is a naturalized citizen,
the time and place of such naturalization.
(4) The location of the place or building
where the applicant intends to operate.
(5) The name of the owner of the building
and if such owner is not the applicant, that
such applicant is the actual lessee of the
premises .
(6) That the place of business for which the
permit is sought is and will continue to be
equipped with sufficient tables and seats to
accommodate twenty-five (25) persons at one
time, and is wholly within the corporate
limits of the city and within the limits of
the area described under Section 3-2009.
(b) Establishes :
(1) That he is a person of good moral charact r
and a citizen of the State of Iowa. '
(2) That the place or building where he inten s
to operate conforms to all laws , health and

fire regulations applicable thereto, and is
a safe and proper place or building; provided
however, that if the applicant is qualified t
obtain a Class "B" permit as determined by
the sworn statements required in the
foregoing subparagraph (a) , and has establish Ed
his good moral character and citizenship
of the State of Iowa, but the place or
building where he intends to operate has not
been constructed at the time the application
is made, or , having been constructed, does no
confrom to the laws , health and fire regulations
applicable thereto or is not a safe or proper
building, the applicant may submit with the
application plans and representations
pertaining to the proposed design dimensions
floor plan, seating and service facilities ,
materials to be used in construction or
remodeling of such place or building, and
such additional information as the Council
may require. If the applicant 's proposal
is approved, the Council may authorize the
issuance of a "provisional permit" on the
usual form provided for Class "B" permits
which shall be designated as such its face.
A "provisional permit" so issued shall be
without bond or fee, but shall in no manner .
be operative as authority to the applicant
to engage in the sale of beer , and shall
have only the effect of conditional approval
by the Council of the applicant 's proposed
plans and representations . At such time as
the place or building where the applicant
intends to operate conforms to all laws ,
health and fire regulations applicable
thereto, and is a safe and proper place or
building, the applicant may apply for a
permit as required by Section 3-2004 of this
Code, and upon determination that the place
or building is safe and proper, and conforms
to the applicable laws and health and fire
regulations , the Council shall grant the
application for a permit.
(c) Furnishes a bond as prescribed in Section 3-2006
Section 3 . All ordinances and parts of ordinances in
conflict herewith are repealed.
Section 4. This ordinance is in full force and effect from
and after its date of publication as provided by law.
