HomeMy WebLinkAbout~Master - Amending Chapter 31 of Municipal Code; Providing for Reconstruction of Sidewalks 4 ORDINANCE NO. 2249 AN ORDINANCE AMENDING CHAPTER 31 OF THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, REPEALING SECTION 31-5017 THEREOF, AND ENACTING A NEW SECTION TO BE NUMBERED SECTION 31-5017, PROVIDING FOR THE REPAIR, REPLACEMENT, OR RECONSTRUCTION OF SIDEWALKS BY THE ABUTTING PROPERTY OWNER; THE MODE OF NOTICE THEREOF TO SUCH PROPERTY OWNER; PERFORMANCE OF SUCH WORK BY THE CITY MANAGER IN THE EVENT OF FAILURE TO DO SO BY SAID PROPERTY OWNER; REPORT OF THE COSTS THERETO TO THE CITY COUNCIL; AND CERTIFICATION OF SUCH COSTS TO BE COLLECTED AS OTHER TAXES ; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE. IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA: Section 1., Section 31-5017 of the Municipal Code of the City of Ames , Iowa, as hitherto existing is hereby repealed. Section 2 . A new section to be numbered Section 31-5017 is hereby added to the Municipal Code of the City of Ames , Iowa, as follows : Sec. 31-5017 . It shall be the duty of the City Manager to require the abutting property owner to repair, replace: or reconstruct sidewalks , but in the event that such work is not completed witYinthirty (30) days of date of deposit in the mails of notice to the property owner as shown in the records of the County Auditor, by Certified Mail, it shall be the duty of the City Manager to cause such work to be done, and to assess the expense thereof on the proper y in front of which work is done. He shall return to the City Council on or before November first of each year an itemized statement of the cost of repairs to be charged against the property abutting upon the sidewalk repaired with a legal description of the property, and, subject to approval by the Council, the same shall be certified and collected as other taxes Section 3 . All ordinances and parts of ordinances in conflict herewith, are hereby repealed. Section 4. This ordinance is in full force from and after its date of publication, as provided by law.
