ORDINANCE NO. 2217
AN ORDINANCE ADDING A DEFINITION OF "CASE OF BEER" TO
ARTICLE II, CHAPTER 3 , MUNICIPAL CODE, CITY OF AMES, IOWA;
CHANGING THE PERMIT FEES FOR CLASS "C" BEER PERMITS ; REPEALING
SECTION 3-2021 OF THE MUNICIPAL CODE, CITY OF AMES, IOWA, AS
HITHERTO EXISTING; REPEALING ALL ORDINANCES AND PARTS OF ORDI-
NANCES IN CONFLICT HEREWITH; AND ESTABLISHING AN EFFECTIVE DATE.
IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES,
IOWA:
Section 1. Section 3-2021 of the Municipal Code, City
of Ames , Iowa, as hitherto existing, is repealed.
Section 2. A new section, to be numbered 3-2021, is added
to Article II, Chapter 3 , of the Municipal Code, City of Ames ,
Iowa, and is as follows :
Sec. 3-2021. Fees for Class "C" Permits . "The annual fee
for a Class "C" Permit for a location for which a permit
has not heretofore been issued is fifty dollars . The
annual fee for a Class "C" Permit for any other location
shall be determined, based on the volume of beer purchased
for sale by the permit holder in business at such location
during the full calendar year next prior to the filing
of the application, as follows :
a. Not more than one thousand cases of beer,
fifty dollars ;
b. More than one thousand, but not more than three
thousand cases of beer, one hundred fifty dollars ;
C. More than three thousand cases of beer, three
hundred dollars ;
Provided, however, that prior to the issuance of any
Class "C" Permit, all applicants , other than applicants
for a permit at a new location, shall certify under oath,
the volume of cases of beer sold for the preceding twelve
month period at the location for which a permit is requested.
Section 3 . A new section, to be numbered 3-2003 . 1, is
added to Article II, Chapter 3 , of the Municipal Code, City of
Ames , Iowa, and is as follows :
Sec. 3--2003 . 1. Case of Beer; defined. "Any other defini ion
to the contrary notwithstanding, the words 'Case of Beer'
as used in determining the Class 'C' Permit Fee under this
Chapter, means that volume of beer in twenty-four sealed
bottles or containers each containing twelve ounces of
beer as offered for sale, regardless of actual size, shag
or capacity of the containers so offered, and shall be
the unit of measurement used to determine the volume of
beer purchased for sale by a permit holder during a given
period. "
Section 4. All ordinances and parts of ordinances in
conflict herewith are repealed.
Section 5. This ordinance is in full force and effect
from and after its passage and publication according to law.
