AN ORDINANCE AMENDING SECTIONS 79-1, 79-8, 79-11
OF THE "FAIR HOUSING ORDINANCE" BY CHANGING SUBSEQUENT
APPOINTMENTS TO TERMS OF THREE YEARS ; BY PROVIDING FOR
THE DESIGNATION AND TERMS OF CHAIRMEN; BY DESIGNATING AN
ACTING-CHAIRMAN; BY CHANGING THE CONFIDENTIALITY OF
PROCEEDINGS ; BY EXEMPTING CERTAIN RELIGIOUS INSTITUTIONS ;
REPEALING SECTIONS 79-1, 79-8, 79-11 AS HITHERTO EXISTING;
ADDING A NEW SECTION THERETO SETTING FORTH THE PURPOSE
OF SAID ORDINANCE; REPEALING ALL ORDINANCES AND PARTS OF
ORDINANCES IN CONFLICT HEREWITH; AND ESTABLISHING AN EFFECTIVE
DATE.
IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF
AMES , IOWA:
Section 1. Sections 79-1, 79-8, and 79-11 of the
Municipal Code of the City of Ames , Iowa, as hitherto
existing, are repealed.
Section 2. A new section to be numbered 79-1,
is added to Chapter 79 of the Municipal Code of the City
of Ames , Iowa, and is as follows :
79-1 Purpose. "The purpose of this ordinance is
to provide for the general welfare of the inhabitants
of the City of Ames, Iowa, by declaring discriminatory
practices in the leasing, sale, financing, showing, and
advertising of real property to be against the public
interest, and by creating a commission for the investigation
and conciliation of complaints thereof. "
Section 3 . A new section to be numbered 79-1. 1,
is added to Chapter 79 of the Municipal Code of the City
of Ames , Iowa, and is as follows :
79-1. 1 Fair Housing Commission Created. "There is
created, for the administration of this Chapter, a
'Fair Housing Commission* . This Commission consists
of five members who shall be appointed by the Mayor with
the approval of the City Council. Three of the members
shall be appointed for terms of two years , and two of
the members shall be appointed for terms of three years .
Members thereafter regularly appointed shall be appointed
for three years . Each regualr term commences on April 1
of the year in which the appointment is made. No person
shall be re-appointed more than once, nor shall he serve
in the aggregate more than six years .
The Chairman of the Commission shall be designated
by the Mayor with the approval of the City Council for
a definite period, not to exceed three years . If the
Chairman is to be absent from Ames for a week or more,
the Commission may designate one of its members as acting-
chairman, to serve during the absence of the chairman.
In any case, where a vacancy is created in the
membership of the Commission by death, resignation,
or otherwise, prior to the normal expiration of the
member's term, the Mayor, with the approval of the City
Council, shall appoint a new member to serve the remaining
portion of the term of the member creating the vacancy.

Any or all members of the Commission may, at any
time, be removed from office by the Mayor with the
approval of the City Council.
After the Mayor and City Council have so designated
the Chairman of the Commission and the length of time he
shall serve as Chairman, the Commission shall elect its
other officers , determine its time and place of meeting,
and may, except as herein provided, adopt such regulations
not in conflict with the Law or ordinances of the City,
as in its own judgment are necessary for the successful
administration of the provisions of this Chapter, and
shall, on or before December 31 of each year, furnish
an annual report to the City Council. A majority of the
members constitutes a quorum for the transaction of
business . "
Section 4. A new section to be numbered 79-8,
is added to Chapter 79 of the Municipal Code of the City
of Ames , Iowa, and is as follows :
79-8 Confidentiality of Proceedings. "In the
event that the committee is successful in effecting a
conciliation between the parties within thirty days
thereafter, or sooner becomes convinced that no discrimination
was practiced, the complaint and all proceedings shall be
and remain confidential; and any disclosure thereof except as
hereinafter authorized, by the Secretary, Assistant-Secretary,
or any other member of the Commission shall be grounds for
removal from office. In the everit that the Commission, upon
investigation, finds no cause of action, and in the event that
the case has received publicity, the Commission may, at its
discretion, issue a statement of no cause of action. "
Section 5 . A new section to be numbered 79-11,
is added to Chapter 79 of the Municipal Code of the City of
Ames, Iowa, and is as follows :
79-11 Exemptions . "Nothing in the foregoing sections
applies to:
a. The rental or leasing of a housing accommodation
in a building which contains housing accommodations
for not more than two families living independently
of each other, if the owner or members of his
family reside in one of such housing units ;
b. The rental or leasing to fewer than seven persons
within a single housing accommodation by the occupant
or owner of such housing accommodation if he or members
of his family reside therein;
C. Any bona fide religious institution with respect
to any qualifications it may impose based on religion,
when such qualifications are related to a bona fide
religious purpose. "

Section 6. All ordinances and parts of ordinances
in conflict herewith are repealed.
Section 7. This ordinance is in full force and effect
from and after its passage and publication according to law.
