ORDINANCE NO. 2153
AN ORDINANCE regulating the erection, construction, en-
largement, alteration, repair, moving, removal, conversion,
demolition, occupancy, equipment, use, heighth, area and
maintenance of buildings or structures in the City of Ames,
Iowa; providing for the issuance of permits and collection
of fees therefor; declaring and establishing fire districts ;
providing penalties for the violation thereof; and repealing
all of Chapters 47, 48 and 50 of the Municipal Code of the
City of Ames, Iowa, as hitherto existing, and all other ordi-
nances in conflict herewith.
Prior to the passage of this ordinance and as required
by Section 366. 7 of The Code, 1962, as amended:
(a) Pursuant to published notice, a public hearing
has been duly held, and the City Council of the City of Ames ,
Iowa, has determined that the Uniform Building Code, as
amended by this ordinance, is adopted by reference as an
ordinance of the City of Ames, Iowa, to be known as Chapter
47 of the Municipal Code of the City of Ames, Iowa, a muni-
cipal corporation;
(b) An official copy of the Uniform Building Code,
as hereby adopted, including a certificate by the City Clerk
as to its adoption and effective date, is on file at the
office of the City Clerk of the City of Ames, Iowa;
(c) Copies of the Uniform Building Code, as so adopted,
shall be kept available at the office of the City Clerk of
the City of Ames, Iowa, for public inspection and for sale
at cost to the public; and

(d) A copy of the Uniform Building Code, as so adopted,
shall be furnished to the state law library, the municipal
library, to all newspapers of general circulation published
in the City of Ames , Iowa, and all commercial radio stations
situated in the City of Ames, Iowa.
IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES,
IOWA:
Section 1. Chapters 47, 48 and 50, of the Municipal
Code of the City of Ames, Iowa, as hitherto existing, all
ordinances amendatory thereto, and all ordinances and parts
of ordinances in conflict with this ordinance are hereby
repealed. A new chapter, known as Chapter 47 of the Muni-
cipal Code of the City of Ames, is adopted as follows :
"CHAPTER 47
Except as hereinafter provided by specific changes ,
Volume I, Third Printing, and Volume III, 1964 Edition of
the Uniform Building Code, published by the International
Conference of Building Officials , together with the Appen-
dix in said Volume I, are adopted by reference. Three copies
of each in book form were filed prior to the adoption of
this ordinance in the office of the City Clerk, for the use
of and examination by the public.
The following word and phrase substitutions are made
in the Uniform Building Code wherever they appear :

Section 2. Section 101 of the Uniform Building Code is
amended to read as follows :

"Sec. 101. This ordinance shall be
known and cited as the 'Ames Build-
ing Code ' and will be referred to
herein as ' this Code. ' "
Section 3 . Section 103 of the Uniform Building Code
is amended to read as follows :
"Sec. 103 . The provisions of this
Code shall apply to the construction,
alteration, moving, demolition, re-
pair, and use of any building or
structure within the City of Ames ,
Iowa, except work located primarily
in a public way, public utility
towers , and poles, mechanical equip-
ment not specifically regulated in
this Code, and hydraulic flood con-
trol structures .
Additions, alterations , repairs ,
and changes of use or occupancy in
all buildings and structures shall
comply with the provisions for new
buildings and structures except as
otherwise provided in Section 104,
306, and 502 of this Code, or Chap-
ter 413 of The Code, 1962, as amended,
or any Rule or Regulation promul-
gated pursuant to the provisions of
The Code, 1962, as amended.
Where, in any specific case,
different sections of this Code
specify different materials , methods
of construction or other require-
ments , the most restrictive shall
govern. Where, in any specific
case, a section or sections of
this Code specify different mater-
ials , methods or construction or
other requirements , than those in
Chapter 413 of The Code, 1962, as
amended, or any other State Law,
Rule or Regulation, the higher re-
quirements govern and are the re-
quirements of this Code. "
Section 4. Section 104 (g) of the Uniform Building Code
is amended to read as follows :
"Sec. 104 (g) EXISTING OCCUPANCY.
Buildings in existence at the time
of the passage of this Code may
have their existing use or occu-
pancy continued, if such use or
occupancy was legal at the time
of the passage of this Code, pro-
vided such continued use is not

dangerous to life; and provided
that they conform to the require-
ments of Chapter 13 of the Appen-
dix to this Code.
Any change in the use or occu-
pancy of any existing building or
structure shall comply with the
provisions of Sections 306 and
502 ; provided, however, that no
presently existing building or
structure in use group H or I
shall be changed to a new use
group, in whole or in part, un-
less the entire building or struc-
ture is made to conform to the
full requirements of the building
code for new buildings . "
Section 5. Section 201 of the Uniform Building Code is
amended to read as follows :
"Sec. 201. There is hereby estab-
lished in the City of Ames, Iowa,
'The Department of Building In-
spection, ' hereinafter designated
as the 'Building Department, ' which
is under the jurisdiction of the
Building Inspector, who is herein-
after designated as the 'Building
official. ' "
Section 6. Section 202 of the Uniform Building Code is
amended to read as follows :
"Sec. 202 (a) GENERAL. The Build-
ing Official is hereby authorized
and directed to enforce all the
provisions of this Code and those
of Chapters 49, 51, and 52, inclusive,
of the Ames Municipal Code, as well
as Sections 413 . 35 to 413 .46, in-
clusive, and 413 .89 to 413 . 91, in-
clusive, of The Code, 1962, as
amended. For such purpose he shall
have the powers of a police officer. "
Section 7. Section 203 (d) of the Uniform Building Code
is amended to read as follows :
"Sec. 203 (d) RIGHT TO DEMOLISH.
In case the owner shall fail, neg-
lect, or refuse to comply with the
notice to repair, rehabilitate, or
to demolish and remove said build-
ing or structure or portion thereof,

the City Manager may order the owner
of the building prosecuted as a vio-
lator of the provisions of this Code
and may order the Building Official
to proceed with the work specified
in such notice. A statement of the
cost of such work shall be transmitted
to the City Council, which shall cause
the same to be paid and levied against
the property as provided by law. " (368. 9)
Section 8. Section 205 of the Uniform Building Code is
amended to read as follows :
"Sec. 205 (a) It is unlawful for any
person, firm, or corporation to erect,
construct, enlarge, alter, repair, move,
improve, remove, convert, or demolish,
equip, use, occupy, or maintain any
building or structure in the City of
Ames, Iowa, or cause the same to be
done, contrary to or in violation of
any of the provisions of this Code.
Any person, firm, or corporation
violating any of the provisions of this
Code or of Chapters 49, 51, and 52, of
the Municipal Code of the City of Ames ,
is guilty of a misdemeanor, and each
such person shall be deemed guilty of
a separate offense for each and every
day or portion thereof during which
any violation of any of the provisions
of this Code is committed, continued,
or permitted, and upon conviction of
any such violation, such person, firm,
or corporation shall be punished by
a fine not exceeding one-hundred dol-
lars ($100.00) , or by imprisonment not
exceeding thirty days .
(b) Whenever the Building Official
is satisfied that any provisions of this
Code or of Chapters 49, 51, and 52, of
the Municipal Code of the City of Ames ,
has been violated or is about to be
violated, or that any order or direc-
tion made pursuant to this Code has
not been carried out, or is being dis-
regarded, he may request the City Solic-
itor to institute necessary proceedings .
Any civil proceedings , when and if
instituted, shall be brought in the
name of the City of Ames , Iowa. Noth-
ing in this section and no action
taken thereunder will exclude any
other criminal proceedings author-
ized by this Code or any other Law
or ordinance in force, or to exempt
any person violating this Code or any
of the said laws , from any penalty
which might be incurred. "

Section 9. Section 302 (d) of the Uniform Building
Code is amended to read as follows :
"302 (d) EXPIRATION. Every permit
issued by the Building Official
under the provisions of this Code
shall expire by limitation and
become null and void, if the build-
ing or work authorized by such per-
mit is not commenced within six (6)
months from the date of such permit,
or if the building or work author-
ized by such permit is suspended
or abandoned at any time after the
work is commenced for a period of
120 days . Before such work can be
recommenced a new permit shall be
first obtained so to do, and the
fee therefor shall be one-half the
amount required for a new permit
for such work, provided no changes
have been made or will be made in
the original plans and specifica-
tions for such work; and provided,
further, that such suspension or
abandonment has not exceeded one
year. "
Section 10. Section 1601 (a) of the Uniform Building
Code is amended to read as follows :
"Sec. 1601 (a) FIRE ZONES DEFINED.
For the purpose of this Code, the
entire City of Ames, Iowa, is declared
to be and is hereby established a Fire
District, and said Fire District shall
be known and designated as Fire Zones
1, 2, and 3, and each such zone shall
include such territory or portions of
said city as illustrated, outlined,
and designated on a certain map on
file in the office of the City Clerk
of the City of Ames, Iowa, being
marked and designated as 'Fire Zones
of the City of Ames , Iowa, ' which is
hereby adopted as the Fire Zoning
Map of the City of Ames , Iowa, for
the application of the regulations
included in the Uniform Building
Code, 1964 Edition, published by the
International Conference of Build-
ing Officials . "
Section 11. Section 6003 of the Uniform Building Code
is amended to read as follows :

"Sec. 6003 . In the event of any con-
flict between any of the provisions
of this Code and any other ordinance,
resolution, or regulation of the City
of Ames , Iowa, the provisions of this
Code shall govern and prevail. "
Section 12. Section 6004 of the Uniform Building Code
is deleted.
Section 13 . This ordinance takes effect and is in full
force and effect, from and after its passage as provided by
law. "

and acting City Clerk of the City of Ames, Iowa, do hereby certify
that the above and foregoing Ordinance No. 2153 is a true and
exact copy of said Ordinance and that said Ordinance was passed
and adopted by the City Council of the City of Ames, Iowa, at a
regular meeting thereof on the 9th day of August, 1966 ; and was
published in the "Ames Daily Tribune" on the 12th day of August,
1966 .
