ORDINANCE NO. 2137
AN ORDINANCE VACATING AN ALLEY IN BLOCK 1, TOWN OF
ONTARIO, IOWA, BETWEEN ONTARIO STREETS AND HUTCHISON STREETS,
AND RETAINING AN EASEMENT FOR ELECTRICAL DISTRIBUTION PUR-
POSES AND OTHER PURPOSES .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA:
Section 1. That the alley in the Town of Ontario,
Iowa, more particularly described as follows :
The twenty (20) foot alley running in
a North-South direction through Block 1,
Town of Ontario, Iowa, between Ontario
Street and Hutchison Street, (The lots
adjoining said alley are legally described
as Lots 1, 2, 3 , 4, 5, and 6, Block 1,
in the Town of Ontario, Iowa, )
be and the same is hereby vacated as a public alley, provided,
however, that the City of Ames , Iowa, hereby retains and excepts
from such vacation, an easement over, across and under the whole
of such alley for the purpose of locating, maintaining, repair-
ing, constructing, reconstructing, and using, its electrical
distribution system, both overhead and underground; and pro-
vided that no structures or trees may be located, constructed
or maintained beneath any such lines or within eight (8) feet
horizontal from any electrical conductor located therein, and
provided further that the City of Ames , Iowa, also retains and
excepts from said vacation as easement for the purpose of locat-
ing , maintaining, repairing, constructing and reconstructing
telephone and gas lines , and other facilities related thereto.
Section 2. That the Mayor and City Clerk be and they
are hereby authorized and directed to execute on behalf of the
City of Ames , Iowa, a Quit Claim Deed to R. Friedrich and Sons,

Incorporated, the abutting property owners , consistent with
this ordinance, and that the City Clerk be and she is hereby
authorized and directed to make a certified copy of this
ordinance and attach the same to the said Deed.
Section. 3 . All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
Section 4. This ordinance shall be in full force and
effect from and after its passage and publication according
to law.
