HomeMy WebLinkAbout~Master - Amending Chapter 47 of Municipal Code (Building Code) ORDINANCE NO. 2112 AN ORDINANCE AMENDING CHAPTER 47 OF THE BUILDING CODE OF THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA BY REPEALING SECTIONS 47-6, 47-6. 1, 47-7, 47-7. 1, 47-7. 2, 47-7. 3, 47-7. 4, 47-7. 5, 47-7. 6, 47-7. 7 and 47-7. 8 THEREOF; AND, PROVIDING FOR CHANGES IN EXISTING USES IN EXISTING BUILDINGS AND STRUCTURES, AND PRO- VIDING PENALTIES FOR THE VIOLATION HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA: Section 1. That Chapter 47 of the Building Code of the Municipal Code of the City of Ames, Iowa be and the same is hereby amended by re- pealing Sections 47-6, 47-6. 1, 47-7, 47-7. 1, 47-7. 2, 47-7. 3, 47-7. 4, 47-7. 5, 47-7. 6, 47-7. 7 and 47-7. 8 thereof, and the following be and the same is hereby enacted in lieu thereof to be known by said section numbers of the Municipal Code of the City of Ames, Iowa: 47-6. Continuation of Existing Use. The legal use and occupancy of any structure existing on the date of adoption of this Code or for which it had been heretofore approved, may be continued without change, except as may be specifically covered in the building code or as may be deemed necessary by the building official for the general safety and welfare of the occupants and the public. 47-6. 1. Change in use. It shall be unlawful to make any change in the use or occupancy of any structure which would subject it to any special provision of the building code without approval of the building official and his certification that such structure meets the intent of the provisions of law governing building construction for the proposed new use and occupancy and that such change does not result in any greater hazard to public safety or welfare; provided, however, that no presently existing building or structure in use group L shall be changed to a new use group, in whole or in part, unless the entire building or structure is made to conform to the full requirements of the building code for new buildings. 47-7. Except as provided herein, existing buildings or structures when altered or repaired shall be made to conform to the full requirements of the building code for new buildings. 47-7. 1. Alterations Exceeding Fifty Per Cent. If alterations or repairs are made within any period of twelve (12) months, costing in excess of fifty (50) per cent of the physical value of the building. 47-7. 2. Damages Exceeding Fifty Per Cent. If the building or structure is damaged by fire or any other cause to an extent in excess of fifty (50) per cent of the physical value of the building before the damage was incurred. 47-7. 3. Alterations Under Fifty Per Cent. If the cost of alter- ations or repairs described herein is between twenty-five (25) and fifty (50) per cent of the physical value of the building or structure, the building official shall determine to what degree the portions so altered or repaired shall be made to conform to the requirements for new buildings or structures. page two. 47-7. 4. Alterations Under Twenty-Five Per Cent. If the cost of alterations or repairs described herein is twenty-five (25) per cent or less of the physical value of the building or structure, the building official shall permit the restoration of the building to its condition previous to damage or deterioration with the same kind of materials as those of which the building or structure was con- structed; provided that such construction does not endanger the general safety and public welfare and complies with the provisions of article 48-288 in respect to existing roofs. 47-7. 5. Increase in Size. If a building or structure is increased more than ten per cent (10%) in net floor area in any story or the number of stories is increased, the entire building or structure shall be made to conform with the requirements of the building code in respect to means of egress, fire safety, light and ven- tilation. 47-7. 6. Part Change in Use. If a portion of the building is changed in occupancy or to a new use group and that portion is separated from the remainder of the building with the required vertical and horizontal fire divisions complying with the fire grading in table 16, then the construction involved in the change shall be made to conform to the requirements for the new use and occupancy and the existing portion shall be made to comply with the exit requirements of the building code; provided, however, tha no presently existing building or structure in use group L shall be changed to a new use group, in whole or in part, unless the entire building or structure is made to conform to the full requirements of the building code for new buildings. 47-7. 7. Tanks. Only ordinary repairs may be made to tanks use for the storage of flammable liquids in fire district No. 1. 47-7. 8. Physical Value. In applying the provisions of this article the physical value of the building or article shall be determined by the building official based on current replacement costs. Section 2. Any person violating any of the provisions of this ordinance shall upon conviction be subject to a fine not exceeding one hundre dollars or by imprisonment not exceeding thirty days. Section 3. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law. Passed this 21st day of December 1965. LOUISE WHITCOME, City Clerk PEARLE P.
