ORDINANCE NO. 2069
AN ORDINANCE repealing Chapter 29 of the Municipal Code of the City of
Ames, Iowa.
WHEREAS, the Code of Iowa, Chapter 490A, entitled Public
Utility Regulation, gives the Iowa State Commerce Commission broad
general powers to regulate the rates and services of privately owned public
utilities furnishing gas by piped distribution to the public for compensation;
and,
WHEREAS, said Chapter 490A became effective on July 4, 1963, and
thereby preempted to the Iowa State Commerce Commission the entire field
of intra-state public utility regulation to the exclusion of such regulation by
municipal corporations; and,
WHEREAS, prior to July 4, 1963, the City of Ames, Iowa, regulated
the rates to be charged for natural gas sold in the City of Ames, Iowa, under
the provisions of Chapter 29 of the Municipal Code of the City of Ames, Iowa;
NOW, THEREFORE,
BE IT ORDAINED by the City Council of the City of Ames, Iowa:
Section 1. That Chapter 29 of the Municipal Code of the City of
Ames, Iowa, entitled "Gas Rates", and the ordinances contained therein
numbered 837, 913, 949 and 1043 are hereby repealed.
Section 2. This ordinance shall be in full force and effect from and
after its passage and publication as provided by law.
