ORDINANCE NO. 2048
AN ORDINANCE VACATING THE NORTH AND SOUTH ALLEY IN BLOCK 20,
COLLEGE PARK ADDITION FIRST NORTH TO THE CITY OF AMES, IOWA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA,
AS FOLLOWS:
Section 1. That the following alley in Block 20, College Park
Addition First North to the City of Ames, Iowa, and more particularly describe
as follows:
The North and South alley between Grand Avenue and
Hodge Avenue and abutting Lots 1, 2, 3 and 4, Block
20, College Park Addition First North to the City of
Ames, Iowa,
be and the same is hereby vacated as a public alley.
Section 2. That the Mayor and City Clerk are hereby authorized
and directed to execute on behalf of the City of Ames, Iowa quit claim deeds to
said vacated alley to the abutting property owners, said deeds, subject,
however, to a reservation of a perpetual easement and right of way over,
across and under the above described property, for the construction, recon-
struction, alteration, operation, maintenance and repair of any electric or
telephone poles, lines, cables, and subject to the further restriction that no
permanent structures, including fences and trees, shall be erected or main-
tained upon the above said property.
Section 3. That the City Clerk is hereby authorized and directed
to make a certified copy of this ordinance and attach the same to the said
deeds.
Section 4. All ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
Section 5. This ordinance shall be in full force and effect from
and after its passage and publication as provided by law.
