HomeMy WebLinkAbout~Master - Vacating a Portion of an Alley in Block 1, Original Town of Ontario Inst . 14340 Fee $ 1. 50 ORDINANCE NO. 2046 AN ORDINANCE REPEALING ORDINANCE NO. 2041 OF THE CITY OF AMES, AND VACATING A PORTION OF THE NORTH AND SOUTH ALLEY IN BLOCK 1, ORIGINAL TOWN OF ONTARIO, IOWA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA, AS FOLLOWS: Section 1. That Ordinance No. 2041 of the City of Ames, Iowa, be and the same is hereby repealed. Section 2. That the following portion of the North and South alley in Block 1, Original Town of Ontario, Iowa, and more particularly described as follows: The North and South alley between Lots 7, 8, 9, 10, 11, and 12, in Block 1, Original Town of Ontario, Iowa, be and the same is hereby vacated as a public alley. Section 3. That the Mayor and City Clerk are hereby authorized and directed to execute on behalf of the City of Ames, Iowa quit claim deeds to said vacated alley to the abutting property owners, said deeds, subject, however, to a reservation of a perpetual easement and right of way over, across and under the above described property, for the construction, reconstruction, alteration, operation, maintenance, and repair of any electric or telephone poles, lines, cables, and subject to the further restriction that no permanent structures including fences and trees shall be erected or maintained upon the above said property. Section 4. That the City Clerk is hereby authorized and directed to make a certified copy of this ordinance and attach the same to the said deeds. §ection 5. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 6. This ordinance shall be in full force and effect from and after its passage and publication as provided by law. Passed this 2nd day of September 1964. X FT M. Jor n, City Clerk Pearle P.
