HomeMy WebLinkAbout~Master - Amending Chapter 39 of Municipal Code, Providing for Removal of Trees ORDINANCE NO. 2009 AN ORDINANCE AMENDING CHAPTER 39 OF THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SECTION 39-4 THEREOF; AND PROVIDING FOR THE REMOVAL OF TREES UPON THE PUBLIC STREETS, POSTING NOTICE OF SUCH REMOVAL, AND PROVIDING FOR HEARING UPON SUCH REMOVAL. Be It Ordained By The City Council of the City of Ames, Iowa, as follows: Section 1. That Section 39-4 of the Municipal Code of the City of Ames, Iowa, be and the same is hereby repealed, and the following be and the same is hereby enacted in lieu thereof, to be known as Section 39-4 of the Municipal Code of the City of Ames, Iowa: 39-4 Tree Removal. Dead trees, damaged and unsightly trees, and trees that constitute a real danger to safety, may be removed at the direction of the City Manager. If other trees are designated for removal, the City Manager shall cause a notice of such intention to be posted on the particular tree. Such notice shall remain posted for a period of not less than fifteen (15) days, during which period any local resident may file a written objection with the City Manager. If such objections are filed, they shall be referred to the city council and a hearing held thereon at the next regular meeting of the city council, at which time, or at any regular meeting thereafter, the council may authorize the removal of said trees or sustain the objections to such removal. Section 2. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. This ordinance shall be in full force and effect from and after its passage and publication as provided by law. Passed this 17 b day of December, 1963. M. W. Jord City Clerk Pearle P.
