HomeMy WebLinkAbout~Master - Amending Chapter 66 of Municipal Code (Auction Sales) 4 - ORDINANCE NO. 1045 AN ORDINANCE AMENDING CHAPTER 66 ON AUCTION SALES OF THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SECTION 66-1. 4 AND 66-2 THEREOF; PROVIDING A DEFINITION FOR THE WORD OR TERM, SALES; THE REGULATION AND LICENSING OF SUCH SALES AS DEFINED; AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA, AS FOLLOWS: Section 1. That Section 66-1.4 of Chapter 66 on Auction Sales of the Municipal Code of the City of Ames, Iowa, be and the same is hereby repealed and the following definition of the word or term, sales, be and the same is hereby enacted in lieu thereof to be known and designated as Section 66-1. 4 of Chapter 66 of the Municipal Code of the City of Ames, Iowa: 66-1. 4 Sales. The word "Sale" shall mean the sale or an offer to sell to the public at public auction of any new goods, wares or merchandise of any and all kinds and descriptions, or the sale or an offer to sell to the public, of goods, wares and merchandise, new or used, of any and all kinds and descriptions on hand and in stock in connection with declared purpose, as set forth by advertising, on the part of the seller that such sale is a jewelry auction or is anticipatory to the termination, closing, liquidation, revision, windup, discontinuance, conclusion, or abandonment of the business in connection with such sale. It shall also include any sale advertised, either specifically or in substance, to be a jewelry auction, "fire sale" "smoke and water damage sale", "adjustment sale", "creditor's sale", "trustee's sale", "bankrupt sale", "save us from bankruptcy sale", "insolvent sale". "insurance salvage sale", "mortgage sale", "assignee's sale", "adjustor's sale", "receiver's sale", "loss-of- lease sale", "forced-out-of-business sale", "removal sale"; and any and all sales advertised in such manner as to reasonably convey to the public that upon the disposal of the stock of goods on hand, the business will cease and be discontinued. Section 2. That Section 66-2 of Chapter 66 on Auction Sales of the Municipal Code of the City of Ames, Iowa, be and the same is hereby repealed, and the following regulation of such sales be and the same is hereby enacted in lieu thereof to be known and designated as Section 66-2 of Chapter 66 of the Municipal Code of the City of Ames, Iowa: 66. 2 Regulation of Sales. No person, firm or corporation shall publish or conduct any sale of the type herein defined in Section 66-1. 4 without a license therefor and compliance with Sections 66-4 through Section 66-15 inclusive of this Chapter 66. Section 3. Violations. Any person who shall violate, neglect or refuse to comply with any of the provisions of this chapter, or who shall make a false statement in any application for a license as herein required, shall, upon conviction thereof, be punished by a fine of not more than one hundred ($100. 00) dollars, or by imprisonment not exceeding thirty (30) days. -2- Section 4. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 5. This ordinance shall be in full force and effect from and after its passage and publication as provided by law. Passed this 6th day of November , 1962, 1 � C.J Pearle P.
