HomeMy WebLinkAbout~Master - Amending Chapter 25 of Municipal Code (Traffic) a ORDINANCE NO. - 1025 AN ORDINANCE AMENDING CHAPTER 25 ON TRAFFIC OF THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SECTIONS A-3.6, 25-39, 25-40, 25-43, 25-44 AND 25-45 THEREOF; PROVIDING A DEFINITION FOR THROUGH HIGHWAY; DESIGNATING THROUGH HIGHWAYS AND SPECIAL STOP OR YIELD INTERSECTIONS; PROVIDING REGULATIONS FOR ENTER- ING THROUGH HIGHWAYS AND SPECIAL STOP OR YIELD INTERSECTIONS; AND PROVIDING THE PENALTY FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA,. AS FOLLOWS: Section 1. That Sections 25-36, 25-39, 25-40, 25-43, 25-44 and 25-45 of Chapter 25 of the Municipal Code of the City of Ames, Iowa, be and the same are hereby repealed; aril the following enacted to be known as Sections 25-3,6, 25--39, 25-40, 25-41(a), 25-43, 25-44, 25-45, 25-40. 17 and 25-40. 18, respectively of the Municipal Code of the City of Ames, Iowa 25-316. Through (or Thru) Highway. Every highway or portion thereof at the entrances to which vehicular traffic from intersecti3ng highways is required by law to stop or yield before entering or crossing the same and when stop or yield signs are erected as provided in this chapter or such entrances are controlled by a police officer 9r traffic control signal. The term "arterial" shall be synonymous with "through" or "thru" when used in this chapter. 25.39. Entering Through Highway. The driver of a vehicle shall stop or yield as required by this chapter at the entrance to a through highway and shall yield the right of way to other vehicles which have entered the intersection from said through highway or which are approaching so closely on said through highway as to constitute a hazard, but said driver having so yielded may proceed cautiously and with due care enter said through highway. 25-40. Authority to Designate Through Highways and Erect "Stop" or "Yield" Signs. Whenever an ordinance of this City designates and describes a through street it shall be the duty of the City Manager to place and maintain a "Stop" sign, unless said ordinance designates a "Yield" sign on each and every street intersecting such through street or intersecting that portion thereof described and designated as such by any ordinance of this City. 25-41(a). Special Intersections Where "Yield" Required. The City Manager is hereby authorized to erect "Yield" signs at designated intersections where particular hazard exists. Such intersections shall be designated "Special Yield Intersections. " 25-43. "Stop" or Yield Signs. Every "Stop"sr "Yield" Sign shall be in accordance with specifications established by the State Highway Commission and shall bear the word "Stop" or "Yield" in letters not less than six inches in height. Every stop or yield sign shall be located as near as practical at the property line of the highway at the entrance to which the stop or yield must be made, or at the nearest line of the crosswalk thereat, or, if none, at the nearest line of the roadway. 4 -2- 25-44. Stop or Yield Required. When stop or yield signs are erected as herein provided every driver of a vehicle shall stop or yield at such sign or at a clearly marked stop line before entering an intersection except when directed to proceed by a police officer or traffic-control signal. The driver of a vehicle approaching a yield sign shall in obedience to such sign slow down to a speed reasonable for the existing conditions or shall stop if necessary and shall yield the right of way to any pedestrian legally crossing the roadway on which he is driving, and to any vehicle in the intersectim or approaching on another highway so closely as to constitute a hazard. Said driver having so yielded may proceed with caution. 25-45. Entering Stop or Yield Intersection. The driver of a vehicle shall stop or yield in obedience to a stop or yield sign as required herein at an intersection where a stop or yield sign is erected at one or more entrances thereto although not a part of a through highway and shall proceed cautiously, yielding to vehicles not so obligated to stop or yield which are within the intersection or approaching so closely as to constitute a hazard, but may then proceed. 25-40. 17. Maple Avenue from the North line of Lincoln Way to the North line of Fourth Street is hereby designated as a through street. 25-40. 18. Fourth Street from the East line of Maple Avenue to the West line of Hazel Avenue is hereby designated as a through street. Section 2. Any person who shall violate any of the provisions of this chapter or shall fail to comply with any of the requirements hereof shall, upon conviction thereof, be fined not exceeding One Hundred ($100. 00) Dollars, or be imprisoned not exceeding thirty (30) days. Section 3. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law. Passed this 24th day of April , 1962. ord Ay Clerk Pearle P.
