HomeMy WebLinkAboutA004 - Email from City Attorney dated June 30, 2009 Doug Marek/COA To Diane R Voss/COA@COA 06/30/2009 06:35 PM cc aweeks@amespubliclibrary.org, Duane R Pitch er/COA@COA, Sheila K Lundt/COA@COA, Steve Schainker/COA@COA bcc Subject Re: Public Measure on November Ballot[ Diane: I am aware of one additional possibility. I have fielded some questions about petitioning for submittal of the proposed gas franchise for approval at the election, but I don't know whether anyone is actually circulating a petition and collecting signatures. I am guessing we will know more when the ordinance goes before the Council on July 14. If a valid petition is filed, the Code says that the Council must submit the proposal "at the next regular city election or at a special election called for that purpose . . . ." If the City receives a petition by September 18, we would need to add the entire text of the franchise ordinance to the ballot of the regular election. If it's after September 18, we will need to call for a special election. Either way, costs would be borne by the utility requesting the franchise. Doug Marek Ames City Attorney 515 Clark Avenue P.O.
