The City Council met in regular session at Administration Building ,
in the City, at 7:30 o'clock p .m. , on the 31 day of August ,
1982. The meeting was called to order and there were present F. Paul Goodland ,
Mayor, in the chair, and the following named Council Members:
Atherly, Curtis, Hammer, Shank, Thurston
Absent: Parks

ACKNOWLEDGEMENT OF NOTICE OF SPECIAL MEETING
We, the undersigned, being all the members of the Council , d nowledge due, timely,
and legal receipt of Notice of Special Meeting for the called pose of considering
all matters pertaining to setting a date for an electio a levy proposition, and
for the consideration of such other business as ma me before the meeting and do hereby
consent that the meeting be held.
The Council took up and considered the matter of establishing a capital improvements
reserve fund.
Council Member Curtis introduced a resolution entitled : "Resolution
calling an election on the proposition of establishing a capital improvements reserve
fund and levying a tax on all the taxable property within said City" , and moved its
adoption, seconded by Council Member Atherly After due consideration of
the resolution by the Council , the Mayor put the question upon the motion and the roll
being called, the following named Council Members voted:
Ayes: Curtis, Atherly
Nays: Hammer, Shank, Thurston
Whereupon, the Mayor declared the mot' failed.
Upon motion and vote, the meeting adjourned.

RESOLUTION
RESOLUTION CALLING AN ELECTION ON THE PROPOSITION OF ESTABLISHING A CAPITAL IMPROVEMENTS
RESERVE FUND AND LEVYING A TAX ON ALL THE TAXABLE PROPERTY WITHIN SAID CITY.
WHEREAS, it is deemed advisable that a capital improvements reserve fund be
established and a tax levied on all the taxable property within said City at a rate
not exceeding sixty-seven and one-half cents per thousand dollars of taxable value in
addition to all other taxes, for a period not to exceed one year, for the purpose of
accumulating monies to finance the cost of the following capital improvements : bathhouse
and concession area, filter and chlorination equipment and building and related
improvements at Carr' s Swimming Pool ; bathhouse, plumbing and pool equipment including
filtration and chlorination system and related improvements at Old Golf and Country
Club Swimming Pool (hereinafter referred to as the "Project") in accordance with the
provisions of Chapter 384 of the Code of Iowa for the City of Ames , Iowa; and
WHEREAS, pursuant to Section 384.7 of the Code of Iowa, before the City may
establish a capital improvements reserve fund and certify a tax therefor, as aforesaid ,
the City must hold a special election upon the proposition of establishing a capital
improvements reserve fund and levying a tax on all the taxable property within said City
and receive a favorable vote from at least a majority of the total votes cast at such
special election;
NOW, THEREFORE, BE IT RESOLVED by the Council of Ames, Iowa, as follows:
Section 1 . That a special municipal election is hereby called and ordered to be
held concurrently with the general election on Tuesday, the 2nd day of November ,
1982, at which there will be submitted to the voters of the City the following proposition
to wit:
"Shall the City of Ames , in the County of Story, State of Iowa, establish
a capital improvemetns reserve fund pursuant to Section 384.7 of the
Code of Iowa, 1981 , as amended; and shall a tax be levied upon all the
taxable property within said City at a rate not exceeding sixty-seven and
one-half cents per thousand dollars of taxable value, in addition to all
other taxes, commencing with the levy of taxes for collection in the
fiscal year beginning July 1 , 1983, for a period not to exceed one year,
for the purpose of accumulating monies to finance the cost of the following
capital improvements: bathhouse and concession area, filter and chlorination
equipment and building and related improvements at Carr' s Swimming Pool ;
bathhouse, plumbing and pool equipment including filtration and chlorination
system and related improvements at Old Golf and Country Club Swimming Pool ?"
Section 2. That for the election the City shall be divided into twenty-four election
precincts and such precincts and the respective polling places therefor shall be as follows:

The polls for the said election shall be kept open from seven o'clock a.m. until

Section 3. That the Count Commissioner of Elections is hereby authorized and

requested to issue a proclamation and notice of the election on the aforementioned
proposition and of the time and place thereof by publication of such notice in the
Ames Daily Tribune, a legal newspaper, printed who-ly in the English language,
published in and of general circulation in the City of Ames. Such notice shall be
published in that newspaper once not less than four nor more than twenty days before
the date fixed for the election. Such notice shall be in substantially the following
form:

Public notice is hereby given that a special election has been called and ordered
to be held in the City of Ames, Iowa, concurrently with the general election, on Tuesday,
the 2nd day of November , 1982, at which there will be submitted
to the qualified voters of the City, to be by them voted upon, the following form of
ballot:

(Notice to Voters: For an affirmative vote upon the question
submitted, pull down the lever above the word "Yes". For a
negative vote, pull down the lever above the word "No". )

All qualified voters are hereby notified to appear at the date and hours aforesaid,
each voter to appear at the polloing place designated for the precinct in which such
voter resides, or as authorized by law.
This notice is given by order of the County Commissioner of Elections and the
Council of Ames, Iowa, pursuant to Chapters 49 and 384 of the Code of Iowa.

Section 4. That the County Commissioner of Elections is hereby also authorized
and requested to have published a notice of change in polling places not more than
15 nor less than 5 days prior to the election in a legal newspaper printed wholly
in the English language, and of general circulation in the City of Ames. Such
notice must also be posted on each door to the former polling places for City
elections prior to the time the polls are opened on the date set for election and
should remain posted throughout the hours that the polls are open for voting. The
notice shall be in substantially the following form:

Notice is hereby given that the polling places for two of the precincts for the City
of Ames special election to be held concurrently with the general election on
Tuesday, November 2 1982, have been changed. The new
polling places are as follows:

Section 5. That voting machines shall be used for this election and ballots
shall be prepared in such size as will permit the same to be inserted in the proper
place in each voting machine, and voters shall be instructed as to the use of such
voting machines as by law provided, such ballots to be in substantially the following

Section 6. That a printed copy of the entire proposition to be voted upon shall
be permanently displayed in at least two places within each voting precinct and on the
left-hand side inside the curtain of each voting machine in the several voting
precincts within the City, such displays continuing throughout the hours during
which the polls are open.
Section 7. That the absentee ballot counting board will not be provided with
a voting machine and the ballots to be used for absent voters on the proposition at
the election shall be prepared on paper of some color other than white, in substantially
the following form, with the facsimile signature of the County Commissioner of Elections
in the space provided therefor on the back of the ballot:

Section 8. That for the election the Election Precinct Officials of the election
shall be appointed by the Commissioner of Elections not less than fifteen (15) days before
the election all as provided by and in conformity with the election laws of the State of
Iowa.
Section 9. That the results of the election shall be canvassed by the County
Board of Supervisors as provided by law and such Board shall certify the results to this
Council .
Section 10. That all of the foregoing matters are adopted and resolved by this
Council but shall be submitted in writing no later than five o'clock p.m. on the last
day for filing nomination papers for the general election to the Story County Commissioner
of Elections who has the duty to conduct this election, for approval , ratification and
confirmation to the extent required by Iowa law, and such County Commissioner of Elections
shall signify such approval , ratification and confirmation and shall order the election
to be conducted in the manner set forth herein by signing the order attached to this
resolution.

ORDER REGARDING CONDUCT OF ELECTION
I , , County Auditor of Story County, Iowa, do
hereby approve, ratify and confirm all action taken by the Council of Ames, Iowa,
incorporated in the attached and foregoing resolution adopted on the day of
, 1982, by such Council , and as Commissioner of this
election, do hereby order that the special election to be held concurrently with the
general election referred to in such resolution shall be administered and conducted
in the manner provided in such resolution.

had, done and performed up to the present time in relation to said bonds and that
the Council of the City consists of a Mayor and six Council Members.
