HomeMy WebLinkAboutA003 - Resolution No. 82-161 adopted May 25, 1982 RESOLUTION NO. 82- 161 Resolution calling an election on the proposition of issuing general obligation bonds for the purpose of renovating Carr' s Swimming Pool and constructing a bathhouse, and constructing a fifty-meter swimming pool and a bathhouse at the old Golf and County Club WHEREAS , it is deemed advisable that Carr' s Swimming Pool be renovated and a bathhouse be constructed and a fifty-meter swimming pool and a bathhouse be constructed at the old Golf and County Club (hereinafter referred to as the "Project" ) in accordance with the provisions of Chapter 384 of the Code of Iowa for the City of •Ames, Iowa; and WHEREAS , the City intends to contract indebtedness and issue general obligation bonds to provide funds to pay for that portion of the cost of the Project in an amount not exceeding $1 ,360 ,000 ; and WHEREAS , pursuant to Section 384 . 26 of the Code of Iowa, before the City may institute proceedings for the issuance of general obligation bonds for the Project, the City must hold a special election upon the proposition of issuing such bonds and receive a favorable vote from at least sixty percent of the total votes cast at such special election; NOW, THEREFORE, BE IT RESOLVED by the Council of Ames , Iowa, as follows: Section 1 . That a special municipal election is hereby called and ordered to be held in and for the City, on Tuesday, the 13th day of July, 1982, at which there will be submitted to the voters of the City the following proposition to wit: "Shall the City of Ames , in Story County, Iowa, issue its bonds in an amount not exceeding the amount of $1,360 ,000 for the purpose of renovating Carr' s Swimming Pool and constructing a bathhouse and for constructing a fifty-meter swimming pool and a bathhouse at the old Golf and County Club, in and for said City?" -3- BELIN, HARRIS, HELMICK & HEARTNEY, LAWYERS, DES MOINES, IOWA Section 2. That the County Commissioner of Elections is hereby authorized and requested to issue a proclamation and notice of the election on the aforementioned proposition and of the time and place thereof by publication of such notice in the Ames Daily Tribune, a legal newspaper, printed wholly in the English language, published in and of general circulati-on in the City of Ames . Such notice shall be published in that newspaper once not less than four nor more than twenty days before the date fixed for the election. Such notice shall be in substantially the following form: -4- BELIN, HARRIS, HELMICK & HEARTNEY, LAWYERS, DES MOINES, IOWA NOTICE OF SPECIAL ELECTION Public notice is hereby given that a special election has been called and ordered to be held in the City of Ames , Iowa, on Tuesday, the 13th day of July, 1982 , at which there will be submitted to the qualified voters of the City, to be by them voted upon, the following form of ballot: (Form of Ballot) (Notice to Voters: For an affirmative vote upon the question submitted , pull down the lever above the word "Yes" . For a negative vote, pull down the lever above the word "No" . ) [Identification Letter] ( to be circled ) SHALL THE FOLLOWING PUBLIC MEASURE BE ADOPTED: YES NO "Shall the City of Ames , in Story County, Iowa, issue its bonds- in an amount not exceeding the amount of $1 ,360 ,000 for the purpose of renovating Carr' s Swimming Pool and constructing a bathhouse and for constructing a fifty-meter swimming pool and a bathhouse at the old Golf an-� County Club, in and for said City?" That voting machines shall be used for this election and ballots shall be prepared in such size as will permit the same to be inserted in the proper place in each voting machine, and voters shall be instructed as to the use of such voting machines as by law provided , such ballots to be in substantially the following form: ( Form of Ballot) (Notice to Voters: For an affirmative vote upon the question submitted, pull down the lever above the word .."Yes" . Section 5 . That a printed copy of the entire proposition to be voted upon shall be permanently displayed in at least two places within each voting precinct and on the left-hand side inside the curtain of each voting machine in the several voting precincts within the City, such displays continuing throughout the hours during which the polls are open. Section 6 . That the absentee ballot counting board will not be provided with a voting machine and the ballots to be used for absent voters on the proposition at the election shall be prepared on paper of some color other than white , in substantially the following form, with the facsimile signature of the County Commissioner of Elections in the space provided therefor on the back of the ballot: -7- BELIP4, HARRIS, HELMICK & HEARTNEY, LAWYERS, DES MOINES, IOWA (Notice to Voters: For an affirmative vote on any question submitted upon this ballot, make a cross (X) mark or check (V) in the square after the word "Yes" . (Back of Ballot) Official Ballot Bond Proposition Special Municipal Election Date of Election: July 13 , 1982 ( facsimile signature) County Commissioner of Elections Section 7 . That for the election the Election Precinct Officials of the election shall be appointed by the Commissioner of Elections not less than fifteen (15 ) days before the election all as provided by and in conformity with the election laws of the State of Iowa. Section 8 . That the results of the election shall be canvassed by the County Board of Supervisors as provided by law and such Board shall certify the results to this Council . Section 9 . That all of the foregoing matters are adopted and resolved by this Council but shall be submitted in writing at least thirty days before the date of the election to the Story County Commissioner of Elections who has the duty to conduct this election, for approval , ratification and confirmation to the extent required by Iowa law, and such County Commissioner of Elections shall signify such approval , ratification and confirmation and shall order the election to be conducted in the manner set forth herein by signing the order attached to this resolution.
