HomeMy WebLinkAboutA001 - Resolution No. 78-332 adopted September 12, 1978 RESOLUTION NO. 78-332 A RESOLUTION CALLING AN ELECTION ON THE PROPOSITION OF ISSUING GENERAL OBLIGATION BONDS FOR THE PURPOSE OF ACQUIRING RZGIJT- OF-WAY AND CONSTRUCTING A STEAM LINE FROM THE AMES MUNICIPAL POWER PLANT TO MARY GREELEY MEMORIAL HOSPITAL WHEREAS , it is deemed advisable that the City acquire right-of-way and construct a steam line from the Ames (Municipal power plant to Mary Greeley Hospital for the purpose of providing heat to said hospital (herein- after referred to as the "project") in accordance with the provisions of Chapter 384 of the Code of Iowa, 1977 as amended for the City of Ames , Iowa; and WHEREAS , the City intends to contract indebted- ness and issue general obligation bonds to provide the funds to pay for that portion of the costs of the project in an amount not exceeding $1,350,000 ; and WHEREAS , pursuant to Section 384 . 26 of the Code of Iowa , 1977 as amended before the City may institute pro- ceedings for the issuance of general obligation bonds for the project, the City must hold a special election upon the proposition of issuing such bonds and receive a favorable vote from at least 60% of the total votes cast at said special election; NOW, THEREFORE , be it resolved by the City Council of Ames, Iowa, as follows : Section One . That a special municipal election is hereby called and ordered to be held in and for the City, on Tuesday the seventh (7th) day of November, 1978 , in conjunction with the state general election, at which there will be submitted to the voters of the City the following proposition, to wit : "Shall the City of Ames, in the County of Story, State of Iowa, issue its bonds in an amount not exceeding the amount of $1,850,000 for the purpose of acquiring right-of-way and constructing a steam line and necessary appurtenances from the Ames municipal power plant to the city hospital for the purpose of providing hear and energy for the hospital ?" Section two . That the County Commissioner of Elections —is--he—rely authorized and requested to issue a proclamation and notice of the election on the aforementioned proposition and of the time and place thereof by publication of such notice in the Ames Tribune , a legal newspaper, printed wholly in the English language, published in and of general circulation in the City of Ames . Such notice shall be published in that newspaper once not less than four nor more than twenty days before the date fixed for the election. Such notice shall be in substantially the following form: NOTICE OF SPECIAL ELECTION Public notice is hereby given that a special elec- tion has been called and ordered to be held in the City of Ames , Iowa, on Tuesday, the 7th day of November, 1978 , in conjunction with the State general election, at which there will be submitted to the qualified voters of the City, to be by them voted upon, the following form of ballot: (Form of Ballot) (Notice to Voters : For an affirmative vote upon the question submitted; pull down the lever above the word "Yes" . For a negative vote, pull down the lever above the word "No" . ) SHALL THE FOLLOWING PUBLIC MEASURE BE ADOPTED: YES NO "Shall the City of Ames, in the County of Story, State of Iowa, issue its bonds in an amount not exceeding the amount of $1,850,000 for the purpose of acquiring right-of-way and constructing a steam line and necessary appurtenances from the Ames municipal power plant to the city hospital for the purpose of providing heaf and energy for the hospital ?" This notice is given by order of the County Commis- sioner of Elections and the Council of Ames, Iowa, pursuant to Chapters 49 and 384 of the Code of Iowa, 1977 , as amended. That voting machines shall be used for this election and ballots shall be prepared in such size as will permit the same to be inserted in the proper place in each voting machine, and voters shall be instructed as to the use of such voting machines as by law provided, such ballots to be in substantially the following form: (Form of Ballot) (Notice to Voters : For an affirmative vote upon the question submitted, pull down the lever above the word "Yes" . Section Five . That a printed copy of the entire proposition to be voted upon shall be permanently displayed in at least two places within each voting precinct and on the left-hand side inside the curtain of each voting machine in the several voting precincts within the City, such displays continuing throughout the hours during which the polls are open. Section Six. That at the said election the ballots to be used or absent voters on the aforesaid proposition shall be prepared on paper of some color other than white in substantially the following form with the facsimile signature of the County Commissioner of Elections in the space provided therefore on the back of the ballot: (Face of Ballot) (Notice to Voters : For an affirr.-iative vote upon any question submitted upon this ballot make a cross (X) mark or a check (✓) in the square after the word "Yes " . For a negative vote make a simi- lar mark in the square following the word "No" . ) SHALL THE FOLLOWING MEASURE BE ADOPTED: "Shall the City of Ames, in the County of Story, :YES - State of Iowa, issue its bonds in an amount not exceeding the amount of $1,850,000 for the purpose of acquiring right-of-way and constructing a :NO steam line and necessary appurtenances from the Ames municipal power plant to the city hospital for the purpose of providing hear and energy for the hospital ?" That for the election the Election Precinct officials of the election shall be appointed by the Commissioner of Elections not less than fifteen (15) days before the election all as provided by and in conformity with the elections laws of the state of Iowa. Section Eight. That the results of the election shall be canvassed by the County Board of Supervisors as provided by law and such Board shall certify the results to this Council . Section Nine. That all of the foregoing matters are adopted and resolved by this Council but shall be sub- mitted in writing no later than five o ' clock p.m.on the last day on which nomination papers may be filed for the general election to the Story County Commissioner of Elections who has the duty to conduct this election, for approval, ratification and confirmation to the extent re- quired by Iowa law, and such County Commissioner of Elections shall signify such approval, ratification and confirmation and shall order the election to be conducted in the: manner set forth herein by signing the order attached' to this resolution.
