MINUTES OF MEETING TO SET DATE FOR
ELECTION
Ames, Iowa
September 5 1978
The City Council met in regular session at Administration Bldg. ,
in the City, at 7:30 o' clock _L.m. , on the 5th day of September ,
1978. The meeting was called to order and there were present
Lee Fel l inger , Mayor, in the chair, and the following
named Council Members:
Atherly, Curtis, Hammer, Huston Shank Van Drip
Absent: None
The Council took up and considered the proposed fire station
proposition.
Council Member Hammer introduced and caused to be read
Resolution No. 78-328, entitled: "Resolution calling an election on the
proposition of issuing general obligation bonds for the purpose of
acquiring land and constructing a building thereon for use as a fire
station", and moved its adoption, seconded by Council Member
Curtis After due consideration of the resolution by the
Council, the Mayor put the question upon the motion and the roll being
called, the following named Council Members voted:
Ayes: Atherly, Curtis, Hammer, Huston, Shank Van Drie
Nays: None
Whereupon, the Mayor declared the resolution duly adopted and
signed his approval thereto.
Upon motion and vote, the meeting adjourned.

RESOLUTION NO. 78-328
Resolution calling an election on the proposition of
issuing general obligation bonds for the purpose of
acquiring land and constructing a building thereon for
use as a fire station
WHEREAS, it is deemed advisable that the City acquire land and
construct a building thereon for use as a fire station _(hereinafter
referred to as the "Project" ) in accordance with the provisions of
Chapter 384 of the Code of Iowa, 1977, as amended, for the City of
Ames , Iowa; and
WHEREAS, the City intends to contract indebtedness and issue
general obligation bonds to provide funds to pay for that portion of
the cost of the Project in an amount not exceeding $950,000 ; and
WHEREAS, pursuant to Section 384. 26 of the Code of Iowa, 1977, as
amended, before the City may institute proceedings for the issuance of
general obligation bonds for the Project, the City must hold a special
election upon the proposition of issuing such bonds and receive a
favorable vote from at least sixty percent of the total votes cast at
such special election;
NOW, THEREFORE, BE IT RESOLVED by the Council of Ames, Iowa, as
follows:
Section 1. That a special municipal election is hereby called and
ordered to be held in and for the City, on Tuesday, the 7th day of
November , 1978, in conjunction with the State general
election, at which there will be submitted to the voters of the City
the following proposition to wit:
"Shall the City of Ames, in the County of Story,
State of Iowa, issue its bonds in an amount not
exceeding the amount of $950, 000 for the purpose
of acquiring land and constructing a building
thereon for use as a fire station, in and for
said City? "
Section 2. That for the election the City shall be divided into
25 election precincts and such precincts and the respective polling
places therefor shall be as follows:

The polls for the said election shall be kept open from seven
o' clock a.m. until nine o' clock p.m.
Section 3. That the County Commissioner of Elections is hereby
authorized and requested to issue a proclamation and notice of the
election on the aforementioned proposition and of the time and place
thereof by publication of such notice in Ames Daily Tribune
a legal newspaper, printed wholly in the English language, published in
and of general circulation in the City of Ames. Such notice shall be
published in that newspaper once not less than four nor more than
twenty days before the date fixed for the election. Such notice shall
be in substantially the following form:

NOTICE OF SPECIAL ELECTION
Public notice is hereby given that a special election has been
called and ordered to be held in the City of Ames, Iowa, on Tuesday,
the 7th day of November , 1978, in conjunction with the
State general election, at which there will be submitted to the
qualified voters of the City, to be by them voted upon, the following
form of ballot:

(Notice to Voters: For an affirmative vote upon the
question submitted, pull down the lever above the word
"Yes" . For a negative vote, pull down the lever above
the word "No" . )
SHALL THE FOLLOWING PUBLIC MEASURE BE ADOPTED: YES NO
"Shall the City of Ames, in the County of Story,
State of Iowa, issue its bonds in an amount not
exceeding the amount of $950, 000 for the purpose
of acquiring land and constructing a building
thereon for use as a fire station, in and for
said City? "
The polls for the said election will be open from seven o' clock
a .m. until nine o' clock p.m. , of said day, and for said election the
City has been divided into 25 election precincts and the precincts and
the respective polling places therefor will be as follows:

All qualified voters are hereby notified to appear at. the date and
hours aforesaid, each voter to appear at the polling place designated
for the precinct in which such voter resides, or as authorized by law.
This notice is given by order of the County Commissioner of
Elections and the Council of Ames, Iowa, pursuant to Chapters 49 and
384 of the Code of Iowa, 1977, as amended.

Section 4. That voting machines shall be used for this election
and ballots shall be prepared in such size as will permit the same to
be inserted in the proper place in each voting machine, and voters
shall be instructed as to the use of such voting machines as by law
provided, such ballots to be in substantially the following form:

Section 5. That a printed copy of the entire proposition to be
voted upon shall be permanently displayed in at least two places within
each voting precinct and on the left-hand side inside the curtain of
each voting machine in the several voting precincts within the City,
such displays continuing throughout the hours during which the polls
are open.
Section 6. That at the said election the ballots to be used for
absent voters onthe aforesaid proposition shall be prepared onpaper of
some color other than white in substantially the following form with
the facsimile signature of the County Commissioner of Elections in the
space provided therefor on the back of the ballot:

Section 7. That for the election the Election Precinct Officials
of the election shall be appointed by the Commissioner of Elections not
less than fifteen (15) days before the election all as provided by and
in conformity with the election laws of the State of Iowa.
Section 8. That the results of the election shall be canvassed by
the County Board of Supervisors as provided by law and such Board shall
certify the results to this Council.
Section 9. That all of the foregoing matters are adopted and
resolved by this Council but shall be submitted in writing no later
than five o' clock p.m. on the last day on which nomination papers may
be filed for the general election to the Story County Commissioner of
Elections who has the duty to conduct this election, for approval,
ratification and confirmation to the extent required by Iowa law, and
such County Commissioner of Elections shall signify such approval,
ratification and confirmation and shall order the election to be
conducted in the manner set forth herein by signing the order attached
to this resolution.

that as such Clerk I have in my possession or have access to the
complete corporate records of such City and of its officials and that I
have carefully compared the transcript hereto attached with the
aforesaid corporate records and that the transcript hereto attached is
a true, correct and complete copy of all the corporate records in
relation to the calling of a special election to be held on Tuesday,
the 7th day of November 1978, in conjunction with the State
generaelection, on the issuance of General Obligation Bonds of such
City in the aggregate principal amount not exceeding $950, 000 and that
the transcript hereto attached contains a true, correct and complete
statement of all the measures adopted and proceedings, acts and things
had, done and performed up to the present time in relation to said
bonds and that the Council of the City consists of a Mayor and
Council Members.

of the proposed date of election and did thereafter receive written
approval from the Commissioner of such date.

precinct for the aforementioned election was the usual polling place
