That STRAND ASSOCIATES,INC.,a Wisconsin corporation("Strand"),is the current owner of that certain real property in Story County,Iowa,legally described as: Lot Eight(8),Iowa State University Research Park Third Addition,Ames,Story County, Iowa ("Lot-8");and that IOWA STATE UNIVERSITY RESEARCH PARK,an Iowa nonprofit corporation ("ISURP")(Strand and ISURP are hereinafter collectively referred to as the"Grantors"),is the current owner of that certain real property in Story County,Iowa, legally described as: Lot Nine(9),Iowa State University Research Park Third Addition,Ames,Story County, Iowa ("Lot-9")(Lot-8 and Lot-9 are hereinafter collectively referred to as the"Lots"). 2. That Strand,for good and valuable consideration,does hereby grant unto the CITY OF AMES,IOWA,and its successors and assigns(collectively,the"Ci'),sanitary sewer easements upon, underground,over,or across the Southwesterly ten(10)feet of Lot-8("Lot-8 Easement Area-1"),as set forth,described,and identified on the Easement Exhibit(the"Exhibit")(a true and accurate copy of the Exhibit is attached hereto as Exhibit A and incorporated herein by this reference as if fully set forth). 3. That ISURP, for good and valuable consideration, does hereby grant unto the City, sanitary sewer easements upon,underground,over,or across the Northeasterly twenty(20)feet of Lot-9 (the"Lot-9 Easement Area"),as set forth,described,and identified on the Exhibit. 4. That Strand,for good and valuable consideration,does hereby grant unto the City,water main easements upon,underground,over,or across the Northwesterly 132.40 feet of the Northeasterly 10.00 feet of the Southwesterly 20.00 feet of Lot-8("Lot-8 Easement Area-2"),as set forth,described, and identified on the Exhibit. 5. That Strand, for good and valuable consideration, does hereby grant unto the City, sidewalk easements upon,underground,over,or across the Southeasterly 7.00 feet of the Northwesterly 22.00 feet of Lot-8("Lot-8 Easement Area-Y),as set forth,described,and identified on the Exhibit. 6. That Strand, for good and valuable consideration, does hereby grant unto the City, electric easements upon,underground,over,or across those parts of Lot-8,described as follows: A strip of land 10.00 feet in width across part of Lot-8,being situated 5.00 feet on each side of the following centerline: Beginning at a point on the Northwesterly line of said Lot-8 which is 5.00 feet southerly,as measured along the 830.00 foot radius,from the Northerly Corner thereof;thence S52°31'21"E,240.25 feet;thence S00°46 16"W,242.13 feet;thence S52°54'46"W, 16.44 feet,and there terminating ("Lot-8 Easement Area-4")(Lot-8 Easement Area-1,Lot-8 Easement Area-2,Lot-8 Easement Area-3, Lot-8 Easement Area-4, and the Lot-9 Easement Area are hereinafter collectively referred to as the "Easement Areas"),as set forth,described,and identified on the Exhibit. 7. The foregoing rights are granted upon the express condition that the undersigned shall not erect or place within the Easement Areas identified herein any building or other structure or improvement, including, but not limited to, a retaining wall or fence, or any trees, shrubs, or other landscape plantings other than grass or comparable ground cover except with the consent of the City. The City shall have the right to trim or remove trees and shrubs within the Easement Areas to prevent damage to utility service lines of the City located within said Easement Areas. 8. The foregoing rights are granted upon the express condition that the users of the granted rights will assume liability for all damage to the real estate described herein and any adjacent real estate caused by the failure to use ordinary reasonable care in the exercise of the granted rights.
