PERMANENT UTILITY EASEMENT
(NO CONVEYANCE OF LAND)
For the consideration of EIGHT THOUSAND SEVEN HUNDRED AND NO/100-----
(8,700.00)-----DOLLARS and other valuable consideration in hand paid by Iowa
Department of Transportation, MILDRED I. JOHANNES, a single person, does hereby
grant to the CITY OF AMES, IOWA, a permanent utility easement for the purposes of
constructing, reconstructing, patrolling, operating, maintaining and removing electric
lines to be located on said premises, including the necessary pole structures, wires, and
other appurtenances for the transmission and distribution of electric energy and
communications, together with the power to extend to any other party the right to use,
jointly with the City of Ames, any structure placed pursuant to the terms hereof, such
lines to form a part of an electric transmission and distribution system in, to, on, over
and across the following described real estate in Story County, Iowa:
THE UTILITY EASEMENT GRANTED FOR TRANSMISSION LINES IS
TO LAND DESCRIBED AS FOLLOWS:
A parcel of land in the SWI/4 of the NEY4 of Section 18, T83N, R23W of the
5ti, Principal Meridian, Story County, Iowa, as shown on Acquisition Plat,
Exhibit "A", attached hereto, which by this reference is made a part hereof,
more particularly described as follows:
Commencing at the Center of said Section 18; thence N89°12'34"E,
117.86 feet on the south line of the SWI/4 of the NEY4 of said Section 18;
thence N00°35'06"W, 45.00 feet to the existing northerly right of way line
of 245tt' Street, the Point of Beginning; thence continuing N00035'06"W,
386.83 feet; thence N17022'12"E, 455.88 feet; thence N89044'23"E, 79.91
feet; thence S17029'58"W, 495.12 feet; thence S10°49'42"W, 203.96 feet;
thence S03°55'46"W, 149.88 feet to the existing northerly right of way line
of 245t" Street: thence S89012'34"W, 14.59 feet on said existing northerly
right of way line to the Point of Beginning, containing 1.14 acres.
This easement, and a certain Warranty Deed to the State of Iowa, executed by the above
named grantor, are given in fulfillment of a certain Agreement dated May 16, 2016, and
recorded in the Story County Recorder's Office on May 19, 2016, as Instr. Number 2016-
00004263, except for those terms that survive the execution of this document.

The Grantor shall have the right to use and enjoy the surface of said premises as long
as that use does not interfere with the purpose or use of the same by Grantee for any of
the purposes hereinabove granted, and Grantor shall not construct or maintain, or
permit to be constructed or maintained, any house, structure, or obstruction on or over
said easement area.
The Grantee shall have the irrevocable right to survey the property, to conduct
engineering and associated investigations including, but not limited to, care boring, soil
testing, to trim or remove any trees or other vegetation, including crops, growing in said
easement area, which, in the judgment of the Grantee may 'interfere with or endanger
said electric lines, to 'install gates to said easement area in the fences on the property of
Grantor, the right to remove from the strip of land specifically described herein any
obstructions, including buildings and other structures, and of ingress and egress across
Grantor's adjoining rands as well as the lands described herein.
Grantor does hereby covenant with grantees, and successors in 'interest, that grantor
holds the real estate by title in fee simple; that it has good and lawful authority to sell
and convey the real estate; that the real estate is free and clear of all liens and
encumbrances; except as may be above stated; and it covenants to warrant and defend
the real estate against the lawful claims of all persons, except as may be above stated,
Grantor hereby states that the person executing this instrument is duly authorized by
the grantor and has the legal capacity to execute this instrument,
Words and phrases herein, including acknowledgment hereof, shall be construed as in
the singular or plural number, and as masculine or feminine gender, according to the
context.
