Joy, wife and husband, of Story County, Iowa, and Howard B. Johnson and Katherine Johnson, husband and wife, 8or ourselves, successors and assigns, in consideration of the sum of One Dollar and other good and valuable consideration, receipt of which is hereby acknow- ledged, do hereby grant to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, maintain, repair, and use its electric lines, consisting of poles, wires, over- head cables, fixtures, anchors, and other similar equipment, or any part thereof for the sole purpose of constructing a 69, 000 volt power line and other electric lines_for conveying electric current for power and lighting purposes, together with the right to extend to any telephone, electric or power company the right to use jointly with the grantee:: any pole placed pursuant to the provisions hereof, and together with the right to trim any trees or remove any trees where necessary to secure adequate clearance for the safe operation of the electric lines upon or across the following described real estate, to-wit: A parcel of land 15 feet wide, starting at and centered on a point 221 feet South of the West quarter corner of Section 22, Township 84 North, Range 24 West of the 5th P. M., Iowa, thence East 375 feet. It is further agreed by ttt a undersigned that no new trees shall be planted or maintained on said right of way, and that no buildings or other structures shall be built under the said utility lines nor within the distances prohibited by the National Electric Safety Code (National Bureau of Standards Handbook No. 81) or latest revisions thereof. The foregoing rights are granted upon the express condition that the City of Ames will assume all damage to the hereinbefore described property caused by the city's failure to use due care in its exercise of the rights granted; and, that the City will pay for all crop damage during construction, maintenance and repair on said premises.
