HomeMy WebLinkAboutA006 - Resolution No. 22-332 adopted June 14, 2022 RESOLUTION NO.22-332 RESOLUTION APPROVING THE STORM DRAIN EASEMENT FOR A BOX CULVERT AT 2516 LINCOLN WAY FOR THE CITY OF AMES,IOWA WHEREAS,the property owner,F F&F of Ames,LLC,has submitted a Minor Site Development Plan application for a two-story bar and restaurant to be constructed at 2516 Lincoln Way; and, WHEREAS,presently, 2516 Lincoln Way is a vacant site and previous development consisted of three buildings constructed across three lots; and, WHEREAS,the previous buildings were constructed over the in-place box culvert constructed in 1935,and this culvert conveys College Creek under the site as well as beneath the building at 122 Hayward Avenue; and, WHEREAS, at the time of redevelopment at 122 Hayward Avenue, it was determined that the culvert could stay in place as long as an existing conditions assessment of the existing box culvert was performed,in-situ condition of the existing box culvert for load/vibration impacts must be monitored during construction, and a post-construction assessment of the existing box culvert must be completed, all at the developer's expense; and, WHEREAS, there are a total of four properties that sit atop the box culvert;the property at 2516 Lincoln Way, 122 Hayward Avenue,Lot X(City owned parking area),and 110 Hayward Avenue Rear;and, WHEREAS, staff had directed the property owner at 2516 Lincoln Way to go through the same process and enter into an Easement Agreement with the City; and, WHEREAS,on April 25,2022,City staff along with engineers on behalf ofthe developer conducted an inspection of the box culvert and deemed it safe to proceed with construction on top of the structure. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,that the Storm Drain Easement for a box culvert at 2516 Lincoln Way is hereby approved. ADOPTED THIS 141h day of June, 2022.
