RESOLUTION NO. 18-319
RESOLUTION APPROVING VACATION OF ELECTRIC UTILITY EASEMENT
AT 404 S. 4TII STREET
FOR THE CITY OF AMES,IOWA
WHEREAS,a developer has recently purchased properties at 322, 330,334,404,and 408 S.4"
Street; and,
WHEREAS,there is an existing buried electric line crossing the property at 404 S.4"Street,for
which the City has an existing Electric Utility Easement,that is in conflict with the footprint of the new
apartment bilding; and,
WHEREAS, the developer has agreed to pay for the relocation of the buried electric line and
grant a new Electric Utility Easement to the City; and,
WHEREAS,with the electric line relocation,the existing Easement will no longer be necessary.
WHEREAS; pursuant to Iowa Code Section 364.7, notice was given on May 15, 2018, and a
public hearing is being held regarding the proposal of the City to vacate the easement; and,
WHEREAS, vacation of the easement is in the best interest of the City.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES,IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed
vacation of the public utility easement and establishing a public hearing date regarding the proposal has
been made.
2. The public hearing regarding the disposition of the property is hereby closed.
3. The existing Electric Utility Easement across the following described land is hereby
vacated:
The West 5 feet of Lot 5 in Clark's Subdivision to the City of Ames, Story County, Iowa.
ADOPTED THIS 22nd day of May, 2018.
