HomeMy WebLinkAboutA003 - Council Action Form dated July 25, 2017 ITEM # 10 DATE: 07-25-17 COUNCIL ACTION FORM SUBJECT: PUBLIC UTILITY EASEMENT VACATION — 1404 BOSTON AVENUE (PIZZA RANCH) BACKGROUND: As part of the development review process, staff received a request from the developer of the property (building expansion) at 1404 Boston Avenue (Pizza Ranch) to vacate an existing public utility easement. The new building addition will be in conflict with the existing easement that runs along the north property line. Public Works staff contacted all registered right-of-way users to determine the extent of existing utilities in the immediate area as well as future plans in the area. Responses from right-of-way users indicate that there are no current utilities in the easement area and no future plans to utilize the easement area. Mediacom has a service line in the easement that only serves Pizza Ranch, which will be relocated as part of their building expansion project. A map of the area is shown in Attachment A. ALTERNATIVES: 1. Set a date of public hearing for August 8, 2017, to approve vacation of the public utility easement at 1404 Boston Avenue. 2. Do not set the date of public hearing to vacate the existing easement. MANAGER'S RECOMMENDED ACTION: By setting the date of hearing, this will be the first step toward completion of this process and will allow the proposed development on this site to continue to move forward.
