UTILITY RIGHT OF WAY PERMIT AND EASEMENT
THE City of Ames (hereinafter referred to as the Grantor) in consideration of the sum of One
Dollar and other consideration, receipt of which is hereby acknowledged, does grant to the Board of
Regents,State of Iowa, pursuant to Code of Iowa section 262.9(7),for the use and benefit of Iowa State
University of Science and Technology(hereinafter referred to as the Grantee),the perpetual right to
construct, reconstruct, maintain and operate a telecommunications system consisting of underground
raceways, underground vaults,fiber optic,copper and coax cables including all appurtenances required
therefore, including the right of access for equipment and vehicles, and for no other purpose,within the
City of Ames the areas included in this easement for the purposes above enumerated,over, upon,
across or under the following-described real estate situated in the county of Story,state of Iowa,to-wit:

LINES, BEING IN THE SOUTH HALF OF SECTION 15,TOWNSHIP 84 NORTH, RANGE 24 WEST OF THE OF
THE 5TH PRINCIPAL MERIDIAN,AND IN THE NORTH HALF OF SECTION 22,TOWNSHIP 84 NORTH, RANGE
24 WEST OF THE OF THE 5T"PRINCIPAL MERIDIAN, IN STORY COUNTY,STATE OF IOWA,AND SAID
EASEMENT CENTERLINE IS MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING ATTHE SOUTHWEST CORNER OF THE NORTHEAST%OF THE SOUTHEAST%OF SAID
SECTION 15;
THENCE ALONG AND UPON THE EAST LINE OF SAID NORTHEAST 1/4, NORTH 00°09'37" EAST FOR A
DISTANCE OF 162.88 FEET;
THENCE SOUTH 89°59'11"WEST FOR A DISTANCE OF 49.96 FEET,TO THE WEST RIGHT-OF-WAY LINE OF
S. RIVERSIDE DRIVE AS PRESENTLY ESTABLISHED;

CENTERLINE OF THIS EASEMENT;

S. RIVERSIDE DRIVE AS PRESENTLY ESTABLISHED AND THE POINT-OF-TERMINUS OF THIS CENTERLINE;
CONTAINING 23,859 SQUARE FEET, MORE OR LESS

Grantee's entrance upon the Grantor's premises for the purpose of construction on or servicing
said easement, or for the repair or removal of the same, shall be over reasonable routes of access
designated by officials of the Grantor, and any parts of said premises, damaged in the course thereof
shall be promptly replaced or restored by the Grantee.
In the event the Grantor requests a relocation of said facilities and easement because of the
development of the area for the use and benefit of the City of Ames,the Grantee agrees to move or
relocate said facilities to some other suitable locations to be provided by the Grantor,the actual cost of
relocation, not to exceed the depreciated value of the facilities at said time as mutually agreed upon by
both parties, assuming a useful life of twenty five (25)years,to be paid by Grantor, provided that after
ten (10)years from the date of this Agreement the liability of Grantor for the cost of relocation shall
terminate.
The Grantor reserves to itself the right to the full use of said premises for any purpose it sees fit
which does not interfere with Grantee's rights herein granted.
