KNOW ALL PERSONS BY THESE PRESENTS:
That TURN KEY INVESTMENTS,L.L.C.,an Iowa limited liability company("Turn Key"),is the
current owner of that certain real property in Story County, Iowa,legally described as:
Parcel"A"of Lots One(1)and Two(2)in Walnut Ridge Subdivision First Addition and the
East 73.74 feet of the alley in Edgewood Fifth Addition, all in the City of Ames, Story
County, Iowa, as shown on the Plat of Survey filed in the office of the Recorder of Story
County, Iowa,on October 26,2015,as Instrument No. 2015-10398
(hereinafter referred to as"Parcel-A"); and
That CHARLES E. WINKLEBLACK and DEBRA A. WINKLEBLACK, husband and wife
(collectively, "Winkleblack") (Turn Key and Winkleblack are hereinafter collectively referred to as the
"Grantors"),are the current owners of that certain real property in Story County,Iowa,legally described as:
Parcel "B"of Lots One(1)and Two(2)in Walnut Ridge Subdivision First Addition to the
City of Ames, Story County, Iowa, as shown on the Plat of Survey filed in the office of the
Recorder of Story County,Iowa,on October 26,2015, as instrument No. 2015-10398
(hereinafter referred to as"Parcel-B");and
That the Grantors, for good and valuable consideration, do hereby grant unto the INTERSTATE
POWER AND LIGHT COMPANY, and its successors and assigns(the"Grantee"),gas easements upon,
underground,over, or across the following-described real estate(collectively,the"Easement Areas"):
The West five(5) feet of Parcel -B, AND,
The East five(5) feet of the South 221.11 feet of Parcel-A
All the above easements are granted according to the following terms and conditions:
1. Grantee and its successors, assigns, and licensees, shall install, construct, reconstruct,
maintain,and use its gas infrastructure in a safe and prudent manner,and shall restore the Easement Areas in a
good and workmanlike manner, including,but not limited to restoration of lawns by sodding or seeding.
2. The foregoing rights are granted upon the express condition that the users of the granted rights
will assume liability for all damage to the real estate described herein and any adjacent real estate caused by the
failure to use due care in the exercise of the granted rights.
