RESOLUTION NO. 15-050
RESOLUTION APPROVING VACATION OF WATER MAIN EASEMENT AT
230 SOUTH DUFF AVENUE
FOR THE CITY OF AMES,IOWA
WHEREAS, there are an existing 12-inch water main easement that runs from east to west
through the middle of the lot on the property located at 230 South Duff Avenue; and,
WHEREAS,the new owner of the property intends to abandon the water main; and,
WHEREAS,it is determined that the current location of the water main easement is no longer
needed due to the ownership and configuration of a new building on the lot; and,
WHEREAS,pursuant to Iowa Code Section 362.3,notice was given on January 20,2015,and
a public hearing is being held regarding the proposal of the City to vacate the easement; and,
WHEREAS, vacation of the easement is in the best interest of the City.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES,IOWA THAT:
1. Pursuant to Iowa Code Section 362.3, publication of notice regarding the proposed
vacation of the water main easement and establishing a public hearing date regarding the
proposal has been made.
2. The public hearing regarding the vacation of the easement is hereby closed.
3. The water main easement across the following described land is hereby vacated:

From the southeast corner of Lot 12, Block 4 of Kingsbury's Addition to the City of
Ames, thence west 10' along the south line of said Lot 12 to the point of beginning;
thence continuing west 270'to the southwest corner of Lot 11, Block 4 of Kingsbury's
Addition;thence north 15';thence east 270';thence south 15'to the point of beginning;
all within Parcel E of Kingsbury's Addition.
ADOPTED THIS 27`h day of January, 2015.
