EASEMENT
FOR PEDESTRIAN SIDEWALK
KNOW ALL PERSONS BY THESE PRESENTS:
That the COLLEGIATE PRESBYTERIAN CHURCH OF AMES,IOWA(hereinafter called"Grantor"),
their successors and assigns,for One Dollar($1.00)and other good and valuable consideration,receipt of which
is hereby acknowledged, does hereby grant unto the CITY OF AMES, IOWA, a municipal corporation
(hereinafter called"Grantee"),its successors and assigns,the perpetual right to enter upon the land hereinafter
described and the perpetual right to construct,reconstruct,maintain,repair and use,a sidewalk for the purpose of
pedestrian use and conveyance,upon,underground,over or across the land described as:
A part of Parcel"D"as shown on the Plat of Survey recorded in Instrument#08-08062 on slide
335,page 3 and 4,of Sublot 1 of Lot 13,in a subdivision of the West Half of the Southwest
Quarter of Section 4,Township 83 North,Range 24 West of the Fifth Principal Meridian,in the
City of Ames, Story County,Iowa and more particularly described as follows:
Beginning at the Northwest corner of said Parcel"D"also the Northwest corner of said Sublot 1
of Lot 13;thence North 8893'55"East and the North line of said Parcel"D"7.50 feet;thence
South 33°20'09"West, 13.39 feet to the West line of said Parcel"D";thence North 00°43'30"
West along said West line, 11.00 feet to the point of beginning,
containing 41 square feet,and all as shown on the plat attached and made a part hereof.
Grantor(s)shall not cause or permit any trees or shrubs or above ground structures or obstructions to be
located within the above described land.
Grantee(s)shall assume liability for all damage to the real estate described herein to the extent that such
damage is caused by failure of the Grantee to use due care in the exercise of the rights granted by this easement.
