Dear Mr. Bishop:
It is my understanding that the City of Ames desires a Hold Harmless Agreement
from us regarding the sewer and water lines which may run under the improvements
at the North Grand Plaza Shopping Center. This letter is to advise you that
General Growth Properties, the lessee of the shopping center site, will grant the
City of Ames an appropriate Hold Harmless Agreement relieving the City of any
liability which may result from the running of these utility lines underneath the
improvements. The Hold Harmless would not, of course, extend to any relief
of liability resulting from the City's negligence.
In the event the City of Ames requires any additional easements regarding utility
lines, we will grant any such easements which you desire. The exact locations,
if not presently ascertained, will have to be determined by "as built" surveys
made after the utility lines are installed.
I can assure you that any and all easements or other agreements which you may
require will be executed and delivered to you by General Growth Properties. If
there are any specific agreements which you would require at this time, please
advise and we will be happy to process same.
