RIGHT OF WAY PERMIT AND EASEMENT
Erben A. Hunziker and Margaret H. Hunziker, husband and wife;
Donald M. Furman and Ruth W. Furman, husband and wife; and Sidney
Westrum and Geraldine Westrum, husband and wife; Mary Ford and
Jeffery Ford, wife and husband; Beverly M. Erickson and
Virgil F. Erickson, wife and husband; Clara Mae Carlson and Chester G.
Carlson, wife and husband; and Gordon Speck,a%(hff1e.T$d%ecfkkrUe, in consider-
ation of the sum of One Dollar and other valuable consideration, the receipt
of which is hereby acknowledged, do hereby grant unto the City of Ames. Iowa,
a municipal corporation, its successors-and assigns, the right to enter upon
the land described, and the perpetual right to construct, reconstruct, clean
up, operate, maintain, cover over and repair a storm sewer and sanitary
sewer upon, under and across the land described as follows:
A strip of land 10 feet wide, the center line described as
follows: Beginning 175. 5 feet East and 33 feet North of
the Southwest corner of the Northeast Quarter of the
Northeast Quarter of Section 34, Township 84 North, Range
24 West of the 5th P. M., thence North 000 031 30" West
912 feet, thence North 160 411 30"West 245 feet; thence
North 670 551 30" East 126. 9 feet; thence North 740 281
30" East 315. 1 feet to a point 801 feet West of the Northeast
corner of said Section 34, also beginning at a point 1099. 8
feet West and 96. 7 feet South of the Northeast corner of
said Section 34, thence North 30 13' 30"East 96. 7 feet to
the Southwest corner of Lot 11 of North Park Subdvivision,
also a strip of land 5 feet wide lying South of a line described
as follows: beginning at a point 801 feet West of the Northeast
corner of Section 34; Township 84 North, Range 24 West of
the 5th P. M., thence East 751 feet along the North line of
the Northeast Quarter of the Northeast Quarter of said
Section 34.
There is also hereby granted a temporary right of encroachment over
and across adjacent land on each side of the above described property caused
by said City:s failure to use due care in its exercise of the rights granted.
