EASEMENT FOR ELECTRIC LINE

EASEMENT
Randy L. Stoeber and Caron Stoeber, a married couple, referred to as "Grantor", in consideration of
the promises made herein by the grantee and the sum of$ 3,704.00 paid by the grantee, receipt of
which is acknowledged,grant to the CITY OF AMES,Iowa,a Municipal Corporation,its successors
and assigns, a perpetual easement upon, over, under and across, the real estate described on the
attached Exhibit A,referred to as the Easement Area.
This easement grant is for the purposes of constructing, reconstructing, patrolling, operating,
maintaining and removing electric lines to be located on the Easement Area, including the necessary
pole structures,wires,and other appurtenances for the transmission and distribution of electric energy
and communications,together with the power to extend to any other party the right to use,jointly with
the City of Ames, any structure placed pursuant to the terms hereof for purposes of the transmission
and distribution of electric energy and communications, such lines to form a part of an electric
transmission and distribution system.
The City of Ames shall have the irrevocable right, to survey the Easement Area, to conduct
engineering and associated investigations including, but not limited to, core boring, soil testing, to
trim or remove any trees or other vegetation, including crops,growing in said Easement Area, which,
in the judgment of the City of Ames,may interfere with or endanger said electric lines,to install gates
to said Easement Area in any fences on the property of Grantor, the right to remove from the
Easement Area any obstructions,including buildings and other structures. The City of Ames shall not
have the right to fence the Easement Area.
In consideration of such grant, the City of Ames agrees that it will repair or pay for any damages
which may be caused to crops,fences, or other property by the construction, maintenance or removal
of said line to the party damaged. Subject to the rights of the City of Ames hereunder, Grantor shall
have the right to cultivate,use and occupy the Easement Area except that no structure or object,

permanent or temporary,shall be erected,no wells shall be drilled,no storage of materials of any kind,
nor shall any ground elevation changes be made on the Easement Area without the written consent of
the City of Ames. No brush or flammable materials shall be deposited or accumulated or burned upon
Easement Area. No act shall be performed on the Easement Area which violates the clearance
requirements of the National Electrical Safety Code as adopted by the Iowa Utilities Board or its
successor.
The City of Ames shall compensate Grantor for any losses based on the following formula. At any
time during the growing season crops are removed,the City of Ames shall reimburse Grantor,for any
loss of rent realized, at a rate equal to the then effective rental rate per acre that Grantor has contracted
to receive from Grantor's tenant, if the Premises are rented. If the Easement Area is being farmed by
Grantor, then the rate shall equal the average yield per acre of the Easement Area for the prior three
years multiplied by the price per bushel for the crop being removed as of the date it is removed. The
City of Ames will separately deal with Grantor's tenant(if there is a tenant)for any damages to which
Grantor's tenant may be entitled for crop loss.
Caron Stoeber is not a titleholder of the Easement Area. She executes this document solely for the
purpose of relinquishing her spousal rights but for no other purpose. The City of Ames acknowledges
this and agrees that Caron Stoeber shall not be held responsible for any of the obligations of Grantor
under this document.
IN WITNESS WHEREOF, the parties hereto have executed this Option and Easement
Agreement as of the day and year first above written.
