RAW WATER MAIN EASEMENT
KNOW ALL PERSONS BY THIS INSTRUMENT that EASTWOOD OF AMES,INC,
its successors and assigns,in consideration of the sum of one dollar($1)and other good and valuable
consideration, receipt of which is hereby acknowledged, does hereby grant to the City of Ames,
Iowa,a municipal Corporation,its successors and assigns,the perpetual right to construct,maintain,
repair and use a raw water main and apparatus and other public facilities upon, underground, over
and across the following described real estate:
That part of the Northeast Quarter (NE 1/4) of the Southeast Quarter (SE 114) of
Section Two(2),Township eighty-three(83)North,Range twenty-four(24)West of
the 5th p.m., in the City of Ames, Iowa, and being 10.00 feet on each side of the
following described centerline:
Commencing at the Northeast corner of Lot A, Block 1,of Lew Cole's Subdivision,
being an official plat;thence south 88'55'16"west along the north line of said Lot A,
Block 1, a distance of 132.75 feet to the point of beginning; thence north 5°06'05"
east,87.45 feet;thence north 1°50'12"west,73.73 feet;thence north 43°38'08"east,
15.89 feet; thence north 88°38'08" east, 118.62 feet to the point of terminus,
easement lines extended and shorten to begin at the north line of said Lot A,Block 1,
said easement contains 0.14 acres (5,914 s.f.).
See the attached Plat of Easement marked and made a part hereof.
The foregoing rights are granted upon the express condition that the users of the granted rights will
assume liability for all damage to the real estate described herein and any adjacent real estate caused
by failure to use due care in the exercise of the granted rights.
This grant of easement and right of way shall be binding upon the heirs, successors, and assigns of
the Grantors.
