Brian D.Torresi,2605 Northridge Pkwy.,Ste. 101,Ames,IA 50010 CITY OF AMES, IOWA RESOLUTION NUMBER 14-097 VACATING EASEMENT IN RINGGENBERG PARK SUBDIVISION FOURTH ADDITION, AMES,STORY COUNTY, IOWA WHEREAS, the City of Ames, Iowa has been presented with a request by Friedrich Land Development Company, L.L.C., the current owner of the real estate described as: Lot Twelve (12), Ringgenberg Park Subdivision Fourth Addition, Ames, Story County, Iowa (the"Burdened Property"),to vacate a portion of the easement located within the Burdened Property as granted by that certain Sanitary Sewer Easement Agreement dated November 7,2008,and filed in the office of the Recorder of Story County, Iowa,on August 11,2004, as Instrument No. 09-10294 (the"Easement"), the vacated portion of the Easement being legally described as follows: A strip twenty (20) feet in width across Lot Twelve (12), Ringgenberg Park Subdivision Fourth Addition, Ames, Story County, Iowa, being more particularly described as follows: Commencing at the Northeast Corner of said Lot 12; thence SO1°13'07"E, 320.85 feet along the East line of said Lot 12, thence S86'56'58"W, 21.86 feet to the point of beginning; thence S86'56'58"W, 300.13 feet; thence S24'01'18"E, 14.25 feet;thence S19'32'28"E,6.98 feet;thenceN86'56'58"E,291.02 feet; thence NO2'44'19"E, 20.10 feet to the point of beginning and as shown on the Vacation Exhibit attached hereto as Exhibit A; and WHEREAS, Iowa Code § 354.23 allows vacation after public hearing and such public � a hearing was duly held on this date; and NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa, that the above-referenced portion of the Easement is hereby vacated pursuant to Iowa Code§3 54.23.
