HomeMy WebLinkAboutA001 - Purchase Agreement PURCHASE AGREEMENT FOR EASEMENT IT IS AGREED between Charles T. Jahren and Jean M. Nicol Jahren, ("Sellers") and the City of Ames,Iowa,('Buyer")that Sellers agree to sell and Buyer agrees to buy a perpetual easement right- of-way over,on,under,through,across,and within the real estate described as shown and described on the shared use path agreement attached hereto, with any easements and appurtenant servient estates,(the 'Basement")upon the following terms: 1. PRICE. he total purchase price for the easement is S C 13, D 5 dollars($�.Ond other valuable consideration,which Buyer shall pay to Sellers no later than such time as all easements required for this project are obtained. 2. EFFECTIVE DATE. This Purchase Agreement and the attached Shared Use Path Agreement become effective upon payment of the purchase price by the Buyer to the Sellers. 3. TEMPORARY EASEMENT. Seller also grants to Buyers a Temporary Easement as described and shown as such on Exhibit A,which is attached. Said Temporary Easement shall terminate upon completion of this shared use path project. The total chase price for the Temporary Easement is $-e dollars ($ _X and other valuable consideration,which Buyers all pay to Seller no later than such time as all easements required for this project are obtained. 4. AGREEMENT BINDING ON SUCCESSORS IN INTEREST. The document shall apply to and bind the heirs, executors, administrators, partners, assigns and successors in interest of the respective parties. 9. INTENTION OF USE OF WORDS AND PHRASES. Words and phrases contained herein, including the acknowledgment clause, shall be construed as in the singular and plural number,and as masculine, feminine or neuter gender,according to the context.
