PUBLIC UTILITY EASEMENT
FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) and other valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the Grantor, Story
Construction Company, does hereby grant and convey to the Grantee, THE CITY OF AMES,
IOWA, perpetual easement and right-of-way in, over, upon, through, and under the following
described premises:
A strip of land 25.0 feet in width across lot 2, Skunk River East, First Industrial Addition
and Lot 3, H&B Subdivision in the Southeast Quarter of the Southwest Quarter of Section 1:
Township 83 North, Range 24 West of the 5`I' P.M., City of Ames, Story County, Iowa being
situated 15.0 feet East and 10.0 feet West of the following described centerline: Beginning at a
point on the South line of said lot 2 which is 15.0 feet West of the Southeast confer thereof:
Thence N00°02'04"W, 490.68 feet: Thence N21°45'39"W, 440.96 feet to a point on the
Northwesterly line of said lot 3, and there terminating, containing 0.54 acres.
as shown on the attached Amended Easement Plat, only for the purpose of, to locate, relocate,
replace, construct, reconstruct, repair, operate, maintain, patrol and/or remove a water
line in, on, through, over, under and across the described land. For the purposes
aforesaid, the Grantee, its officers, employees, agents, licensees, successors, and assigns shall at
all times have the right and privilege of access to the above described premises.
The foregoing rights are granted upon the express condition that the users of the granted
rights will assume liability for all damage to the real estate described herein and any adjacent real
estate caused by failure to use due care in the exercise of the granted rights.
These grants of easement and right of way shall be binding upon the heirs, successors,
and assigns of the Grantor.
